OK, that’s not really the title of this new Administration of Justice Bulletin by my colleague Jessie Smith, but it could be. It’s actually called Understanding the New Confrontation Clause Analysis: Crawford, Davis, and Melendez-Diaz. It’s designed to lay out the law in the clearest possible terms, including a flow chart on page 6 that walks you through the issues you need to consider when evaluating a Confrontation Clause issue. I think it’s great, but you don’t have to take my word for it: Jessie has used almost-final versions of this paper as a handout in some recent teaching sessions, and it has received rave reviews. And of course, the point of mentioning it here is that you can check it out yourself. It’s available now as a free download.
