New Service: Fourth Circuit Case Summaries

Semi-retired faculty member Bob Farb has begun a new service that may be of interest to some readers. He is summarizing select published Fourth Circuit opinions. Generally, he will focus on criminal cases and civil cases that have a criminal law connection. For example, his first summary concerns Owens v. Baltimore City State’s Attorneys Office, ___ F.3d ___, 2014 WL 4723803 (4th Cir. Sept. 24, 2014), a civil case filed under 42 U.S.C. § 1983 alleging in part that law enforcement officers intentionally withheld exculpatory evidence in a murder case.

The summaries are available here. There’s no charge for the service. There isn’t currently any way to subscribe to it. However, I hope that when especially significant decisions are announced, Bob can be persuaded to blog about them.

  1. This looks like another great SOG service, but the links in the post don’t seem to work. Hope this can be corrected.

  2. The only link in the blog post is the word “here.” It works for me, on a couple different browsers. Perhaps try a refresh or a different browser and see if it works?

    I was able to open the link. It had a summary of a murder case. The Officers and Agents of the State or the United State’s have immunity ‘only’ when they are acting within the scope and preview of the job description’ and none when their actions are taken ‘under the color of law and official right’.

    They are bound to ‘specific performance’ anything outside that narrow definition is outside their lawful authority and right, and is considered to be under the color of law’.
