New Legislation Regarding the Restoration of Felons’ Gun Rights

I’ve blogged previously about the Britt and Whitaker cases. Britt held that a particular convicted felon retained his right to bear arms under the state constitution, and that G.S. 14-415.1 — which purports to prohibit all felons from possessing firearms — was unconstitutional as applied to him. Whitaker rejected a similar claim made by another convicted felon and made clear that Britt was an exceptional result, driven by the fact that  the plaintiff in Britt had committed a single, non-violent felony many years earlier, and had since remained completely out of trouble.

Rather than wait for the courts to accumulate case law about which felons are entitled to possess guns and which are not, the General Assembly jumped into the issue during the just-concluded session. It enacted S.L. 2010-108, which attempts to clarify and limit the circumstances under which felons may retain or regain their gun rights. The statute appears to be consistent with the thrust of Britt and Whitaker, although I am sure that it will be challenged by someone who falls outside its scope.

My colleague John Rubin has drafted the following excellent summary of the legislation, for those interested in a bit more detail. I grateful for his willingness to share it:

[The law] [a]mends various statutes, described below, to allow people convicted of certain felonies to apply for restoration of the right to possess firearms and to create an exception from the firearm restrictions for certain white collar criminal convictions. Provides that changes become effective February 1, 2011, and apply to offenses committed on or after that date. Also directs North Carolina Attorney General, effective July 20, 2010, to request the U.S. Department of Justice and other federal agencies to review these changes and determine whether a person who qualifies under them may purchase and possess a firearm under federal firearms restrictions.

New G.S. 14-415.4 contains the new restoration procedures. The new statute gives the responsibility for hearing restoration petitions to the district court in the district where the person resides. New G.S. 14-415.4(i) states that restoration does not constitute an expunction or pardon, and G.S. 14-415.4(l) states that the knowing and willful submission of false information is a Class 1 misdemeanor and permanently bars restoration of firearm rights.

The initial prerequisite for restoration is that the person must have no more than one conviction for a “nonviolent felony,” which does not include any Class A, B1, or B2 felony or any Class C through I felony that involves an assault as an essential element, possession or use of a firearm or deadly weapon as an essential or nonessential element, or other specified circumstances. Multiple nonviolent felony convictions arising out of the same event and consolidated for sentencing count as one felony. A person is ineligible for restoration for various reasons listed in the statute, including having been adjudicated guilty of or having received a prayer for judgment continued or a suspended sentence for one or more misdemeanor crimes of violence or other listed misdemeanors. To obtain restoration, the person must have had their civil rights restored for at least 20 years, which typically occurs automatically under G.S. 13-1 following a person’s completion of all incidents of his or her sentence. The new statute also states that a person who was convicted of a nonviolent felony in another jurisdiction is eligible for restoration if his or her civil rights, including the right to possess a firearm, have been restored for at least 20 years in the other jurisdiction; this provision may inadvertently make the waiting period for restoration of firearm rights in North Carolina considerably longer for people with convictions from other jurisdictions because they may not be able to obtain restoration of their firearm rights in the other jurisdiction for some time after their citizenship rights have been restored there. New G.S. 14-415.4 establishes other criteria a person must satisfy to obtain restoration of firearm rights, such as a one-year period of residency in North Carolina.

The act amends G.S. 14-415.1 (possession of firearm by a felon) to provide that a convicted felon whose firearm rights have been restored is not subject to the prohibition in that statute; similarly, the act amends G.S. 14-404(c) (handgun permits) and G.S. 14-415.12(b) (concealed handgun permits) to provide that people whose firearms rights have been restored are eligible to obtain the indicated permits if they meet the other criteria for issuance. The act also amends the above statutes to exempt from the firearms restrictions felony convictions pertaining to antitrust violations, unfair trade practices, or restraints of trade. People convicted of these felonies do not need to apply for restoration of their firearms rights (unless convicted of other nonviolent felonies); the changes exempt them from the firearms restrictions.

  2. yes i’m a convicted felon but this was back in 1978, i did everything i had to do from what the courts gave to me, since 78 i hav’nt been in anytype of trouble not even a traffice ticket. i would love to get my gun rights restore its been 32 yrs since i been in any trouble and by the way it was’nt a violent crime or a rape or drug related . i have heard that some people how are felons have gotten thier rights restored. i can get a gun anytime but i want to be legal. its so scary nowadays more crime is developing everyday and most of it is violent crime i feel so helpless cause i really dont have anyway to protect myself or family’ i’m 55 yrs old so theres no way i would be able to fight off a younger guy if was to try to fight him and if thiers more then 1 person i’ma goner. i wish somebody out there would help us out. chrismosc1@gmail.com.

  3. chris lets start a petition on a website and get every felon we know to sign and comment on it to fight back for all of our gun rights!!!its a free privilege that they are wrongfully striping us from.i just dont know what else to do!!!………..gibbs…….2nd ammendment rights are our privilege even for the ones that has made mistakes!!!!

        • I will sign as well. Anyone that is trying to turn their life around deserves a second chance just like anyone else. Some of these people that come up with these rules need to put them selves in our shoes or if something was to happen in their family where one of their loved ones was in this type of situation and what they would want for them. I can see why not restoring to crimes against other people or children, drug offenses, or murderers and any other crimes that involves assault on other people. Just think about it.

          • I am a felon i had a petty drug possession charge in Alabama. I was convicte in 2008. I was sent to prison and eosd my sentence in 2010.I havent been in any trouble since i was charged in Nov. 2007 Am i a good candidate ?If so what steps do i need to take.

The Constitution of the United States, Second Amendment the Right to Keep and Bear Arms. This right is fundamental, absolute, and to many including myself sacred. So when a citizen’s Constitutional Right is infringed upon it needs to be for good reason but presently we the people find that Junior Rate Prosecutor’s can take ink pens and infringe upon Constitutional Rights like they are the reincarnation of John Adams. Seriously, my father is currently in prison for being a ‘FELON IN POSSESSION OF FIREARMS” plain language, my father failed to place a place of paper in front of a Judge for signature, if he had preformed this action he would not be in prison right now. He was labeled a Felony 32 YEARS AGO, and released from prison 25 years ago, upon his current incarceration he was a respected member of community, a homeowner, and he lived on the land. He was pulled over for not wearing his seatbelt in the mountains where he was cutting wood with his new chainsaw when he was arrested. Should this man be in jail!!?? Absolutely not! What can I do; are there like minded people? My biggest fear is that my father will die in prison and for what purpose? Last word: His felony conviction was not in any way shape or form firearm related. For a man that would have “OTHERWISE” not been guilty of a crime had he placed a place a paper in front of a Judge for signature.

    • I’ll sign it…It’s the right thing to do….we have the right to protect our families….teach our sons to hunt…..we need to have the ability to protect our homes if(God forbid) a foreign invasion. Not all of us are complete nimrods…because we didn’t go back..we became productive members of Society….some of us do Community services…without being charge with another crime…it’s just high time that we are once again identified as Citizens…We pay taxes too don’t We?

    • I will sign too. I fill just like one of the blogs i read earlier, at what point even after jail time, restitution,and probation have we really paid our debt to society. It’s bad enough that it follows us in the job maket especially any type of decent job. It would seem when i got 30days 6 months of intense probation and 3yrs supervised probation. Once it was exspired I would fully have my life back(Gun Rights/no job discrimination)WRONG. We should petition lets show them we aren’t ignorant and stand up for our right.. It’s written in the constituttion. 2nd Amendment

      • I’ll sign this to. This is just not constitutional to have our 2nd amendment RIGHTS taken away from us. What’s next? Get arrested at a protest rally and have your freedom of speech taken away! I don’t know who comes up with theses laws. They can’t just take away peoples rights after they’ve already paid their debt to society. Something needs to be done to change this.

  4. I am also a convicted felon. I now have a wife, several children, coach little league a own a very reputable company.. should I not be allowed to protect my family?

    • I agree. We need to organize and be united. The past is the past. I ma a convicted felon and last committed a crime in 2003 (Robbery). I served 6 years in prison, it’s been tough to find a job or “forgiveness”. One example of this is the removal of “my god given right to protect myself and or hunt for my own food”.

      At what point has a felon paid his/her restitution to society? And where did this “notion” come form that if you have committed a crime, you can “never” be trusted; after all, ALL criminals were once law abiding people.

      Lastly, lets look at horrors that have been committed using a firearm by people “without” a criminal history?

      Taking firearms and removing “rights” will NOT PREVENT crime….only those of us who “CHOOSE” to change our behavior will change the crime rate….look at the “war on Drugs”….has it stopped the use of or flow of drugs in America?

      What about those who are running OUR country bankrupt, spending more than half again what we generate??? Do you have to be a convicted felon to be a “criminal”

No one ever complains about any body that carrys a M16, a american worker escorting convoys, or a american mechanic sleeping in harms way to keep the wheels of democracy turning. Lawyers, politicians, and many americans wearing name brand suits enjoying freedom thats being hard earned by the very people that will be denied the basic freedom to defend themselves in their own home, once they return to the UNITED STATES.

  7. I was arrested in my teens while I lived in NYC. All stupid stuff. I went on to become a NYC Corrections officer after many attempts. I had a exampllary record until I was appointed a CO. I believe that certain felons should be allowed to apply for a carry permit. Like myself, I did stupid things when I was young. If 20 years has past since the felony and it wasn’t a MR&MRSBAKE felony, why not have an a governor amnesty program set up that will relieve that person from “his/her disability.” Make it 20 years of good standing in the community and then issue something from a judge such as this amnesty.

  8. i have applied a few times to have my rights restored thru the governors clemency office .i haven’t had any luck with that yet.i was convicted of some felonys when i was 15 yrs old.i am now 33 with 3 kids and a very reputible job.i am unsure exactly how the new law that takes place in feb is gonna effect me.i want to be able to hunt.more important i would like to obtain a passport where i could travel to any country and as it sits some countries i won’t be able to visit because of my “troubled youth” convictions …….shed some light if you can plese

  9. I couldn’t agree more. Anyone who has paid his/her debt to society and has proven themself a law abiding citizen should have every right restored. Especially, if is for something done while young and foolish and/or time past. We all make mistakes and we all change over time. As much as some would like to believe, our society is not perfect, but this legislation is a step in the right direction. The courts are not infallible either, which has been proven through (new) DNA evidence. In NC it is a felony to rake and take pine straw from someone without permission – but you might get away with it if you have a “lucrative” legal defense or the “right” political connection.

  10. Anythin new on this? I also did some stupid things when i was younger18-20 that got me a felony conviction. I never knew at the time how much this would affect me later in life. I now have a family, own a buis and pay taxes been over 20 years. With the events in the world today, i should be able to buy a gun “legally” to protect myself and loved ones. I have paid my debt to society…

  11. I was arrested in 1984 for 3 charges. 1) no driver license, 2) auto theft, & 3) hit & run.
    All 3 charges were combined into 1 case and then the court ruled nolo prossed, I am assuming that means not prosecuted and charges were dropped. Here is my problem, even though the charges were dropped i am still unable to purchase or own a firearm. Why is that? How do I go about geting my rights to carry restored. The case mentioned above took place in Florida. NCIS still prohibits me from purchasing a [handgun]. Who do I talk to in order to resolve this?

  12. I was convicted of a class H NC felony in 2007. Is it legal for me to own a black powder rifle, shotgun, and or pistol. Also, can my wife keep a firearm in our house as long as I do not have access to it?

    • The answer to your question is NO!!! Me and my husband just went through this if you live in the state of North Carolina then it is illegal for a firearm to be any where near you ie; your car, home, possession as long as you are around no.

      • They gave you bad information… The powder it takes to load the firearm is considered an ‘explosive device’ and is ‘illegal’ for a convicted felon to own…

  13. My husband was previously married and he purchased a gun without proper paperwork in nc at a gun show. He had his back ground and id and the man was leaving the show and so was my husband emptied handed so he asked if he had what he wanted a very small hand gun and he did. My husband filled out a piece of paper and the man took a copy of my husband drivers livenses and background check told him hed receive the bill of sale for the gun in the mail because he had packed up his laptop and printer. He gave my husband a business card and wrote on the back make model id number amount paid how was paid when and where signed by him. My husband never received the paperwork but he was on the way home and was pulled over with the gun. And got in trouble. For rec/poss a firearm.

    A year later (My husband was previously married) when they had their master spat he had purchased a firearm from her step dad he received the paperwork to fill out properly and the started the process of legitimately own it. He took the firearm to the home because of the crime that had happened in their neighborhood. Three days later they had their arguement he called the law because things got out of hand and he couldn’t resolve it alone. When the police got there they asked if they could go inside and they seen the gun box on top of the dresser as the exwife talked to the police. He took the wife in to commit her and the police ran the cerial numbers and found out it was stolen. Before she was took in for help the officer seen it and she stated he had bought it from her step dad. They got a divorse but he had to take the punishment because they didn’t show up for court.
    My husband got in trouble and that’s it its been seven and a half years he got his divorse eight years ago married six years ago and got off probabtion a year early never failed a drug screening and paid all his fines did his community service and according to the director of probation he uses his story as a example of the probation program used successfully. Has sinced received his two year associates degree as well. He hasn’t been in any other trouble he has bought a home and paid for it and has a successful business and been married to be for five and a half years he would like to get his rights back but most importantly would like to get his record expunaged. Any online legal advice or suggestions? We know its going to be priced and are well prepared for that!

  14. When i was 17 (in 2001) i was arrested for breaking and entering. Due to that i havent been able to get steady employment the last 4 years. I would like to have my gun rights back, as i never really had them to begin with. More importantly id love a job. I’ve been engaged for 6 years and she’s stuck by me when most wouldnt have. Due to no work its not looking like we can get married anytime soon. Its just rediculous that a mistake made at an early age, before you even legally considered an adult can still haunt you when you are an adult. And Harry, no you can’t own one because its considered an “explosive” and a felon cannot reside in a home where a firearm is kept. I’d be glad to sign that petition! I’m so sick of being judged based on a stupid mistake

  15. I was convicted of stealing beer when I was 17 in 1973 or 38 years ago. I currently hold two state licences,have been self employed for over 32 years, am a respected businessman,have put 2 kids through 4 years of college,one of which was a criminal justice degree,have been married for 29 years, dont drink or smoke and have never been in any more trouble.I have not even had a traffic ticket in 20 plus years. Non violent felonies should not be life sentences. These laws need to be revised so that people who demonstrate that they are productive citizens can get another chance and to have the felony removed. I have written letters to all of the legisltors including the Gov. and three Presidents.I made a stupid mistake as a teenager which I made retitution for and this has followed me throughout my life. This is the only thing I am aware of In life that does not go off of your record after time. If you mess up your credit that can be corrected over time. If you get speeding tickets when you are young that also can be corrected over time. It is time to change all felony laws now. I am not a criminal but a 55 year old tax paying law abiding citizen.

When my husband was 16 he got a felon b&e and he did some time for it when he was 33 he was got caught with a gun and took a plea to do time on state only to find out on his release date that the federal government picked up the charges he was sent to court did house arrest for 10 months while working and reported on time everyday just to get a sentence of 68 months more in a federal prison. What is going on why is he was told due to the fact that he was a felon when he was sixteen that he was given so much more time. I feel like that is not right he did his time and was not in any trouble so why is he being punished twice for the same crime?

  17. Hi everybody. I was convicted of a nonviolent felony 10 years ago when I was 19. I am trying to start a movement to petition our government on many issues concerning felony convictions. On our own we are only one voice at a time, but together we can be heard. Most people walking around today with a felony conviction are people who made one bad mistake in their younger years, but they continue to serve a life sentence, one that effects their everyday lives.   18. I’m a 56 year old male. Have two felonies, both non-violent and served 10 months for one, and paid a fine and community service on the other.
    The problem is not only the gun grabbing Congress and State Congresses, but the fact that we, today, have a hugely private controlled prison business.
    Prisons are mostly private businesses today. The Legislators have made an enormous amount of laws that were once simple misdemeanors into felonies. They want to take your/our guns away. It has nothing to do with crime. It is an attempt to disarm the general public. People without guns can not fight back. It is a blatant crime what they are doing. I believe, just my opinion, that if you do not use a gun in the commission of a crime, there is zero need to take that right away. If you use a gun in the commission of a crime, you deserve to lose that right, for that person is a proven danger to society. Unfortunately, we are all balled into one category = a felon.
    I’m not sure what can be done, if anything, but a petition with all of us participating sounds like a decent start.
    I have not since, even had a parking ticket. Yet, I’m not allowed to protect my property or myself or family from robbers that would break into my home.

THEY CAME TO MY HOUSE…TO SERVE A WARRANT FOR SOME GIRL THAT I NEVER HERD OF… THEY WERE 2 MILES FROM THE CORRECT ADDRESS THEY WERE SUPPOSED TO BE AT SURROUNDED MY HOUSE WITH GUNS OUT FRONT AND BACK DOOR AND AT MY BACK WALL I HAD 3 INCH TALL PLANTS 12 OF THEM…THEY STOMPED ON ALL THE RIGHTS EVER SOLDIER.. HAS DIED FOR US..!!!   21. Can a homeowner who is otherwise legally able to own firearms keep a firearm in his / her home if a boyfriend / girlfriend also living in the home is a felon?

    Can the firearm be kept readily available for defense by the homeowner?

    If a home invasion occurs, and the conditions for the use of deadly force are present, if the felon partner grabs the gun and kills such a home invader, will either / both homeowner and felon resident be subject to a charge of murder, due to the felon, illegally possessing the firearm which he / she used to repel the attacker, having thereby “killed a person in the commission of a felony”?

    • The answer to that question in Virginia is NO! The VA Supreme Court has decided that if a felon is in proximity to a firearm, that he has access to the firearm even if he is not the owner of the firearm then the felon is considered to have control of the firearm therefore the felon is in possession of the firearm. You should check the nc supreme court decisions on this issue and check to see if the state code is clear on the issue.

  22. Same things just happened to me. I was convicted of a non-violent felony 12 years ago and recently applied to have it “set aside” and my gun rights restored. I just received a letter from the Tucson AZ Judge that my conviction is set aside, all rights restored EXCEPT my gun rights. I will follow up on this, as it seems unfair and unconstitutional.
    I don’t necessarily want a gun, but I don’t like being denied my rights.
    I don’t have money for lawyers, any suggestions??

    I am in the same situation as everyone else. I am sure there are enough felons in this country to push something through. It will take time and money – that is what our judicial system revolves around. Maybe some one can organize a group. maybe a business owner can start with some money, maybe everyone who post here can put up some money.
    There are 5.3 million registered felons in the USA, If only 1,000,000 felons put up $100.00 dollars each. That will buy our gun rights back.

  24. I’m in. I have a 6 year old Felony DUI that was not handled well by my “lawyer”. I am trying to get it reduced to a misdemeanor, and I hope that will restore my gun rights. Non-violent felons need to get together to make a change to this. I can’t protect my family, or hunt, or just even have a toy because I drove after 4 beers six years ago? I will pay whatever, whenever. Lets get this organized.

  27. i was convicted of a non violent felony at 18 since i have served in the armed forces (they had no problem waiving my felony) and left with an honorable discharge after 6yrs, 2 of which were in iraq and 1 in afghanistan. I have been a successful business owner with a flawless record yet i cannot own a gun to protect my own family or hunt my own food. My request to have my amendment rights restored has been denied. Today is a sad day for our country for they have now perfected the way to turn an honest man into an outlaw. May god have mercy on all our souls…………….

Amazing but not really..White collar criminals that cheat and steal millions from investors and tax payers can get their rights back but everyone else can’t no matter how long it has been since the event. More discrimination and you guys are buying into it. The only way to get rights back is to take them back with political action committees and lobbyist paying the lawyers to pay the judges to pay the politicians. (not necessarily in that order). So if you (we) really want to do something about this disenfranchisement we must put our money where our mouths are and stop whining or begging for something back the government had no right to take in the first place.

  29. I alike many of you are in the situation where all my rights have been restored except the right to bare arms… It has been many years since my conviction (1997). I applied for clemency and spoke directly to the governors office only to hear rediculas denials that since I served in the military I was more of a threat than most. I no longer live in NC, but what I find more amazing is one felony that may be against the law in one state is not a crime at all in another, and yet I cannot own a firearm in any state.
    All these laws do is force people who want to protect themselves and participate in cultural traditions such as hunting, to hide and in my opinion become a larger threat. would it not be easier to let everyone own weapons, and keep records of where those guns are? I do not consider myself a danger. I actually fear a lot of people who carry firearms daily, but there is a basic right by our forefathers to protect ourselves especially against a government that no longer supports our rights or beliefs. This stuff really stirs me sometimes and I wonder what these people think creating these unconstitutional rules that I think are meant to be broke. Even Roman slaves captured from enemy tribes had the right to gain full citizenship. …and from that example I say… we are doomed as a society if we cannot fix issues like this. People are so afraid of the majority that they will not do what is right for the people. That is the true crime. Here’s one thought… there are more first time offenders than repeat offenders… I would not be suprised to see every firearm removed in the future from every citizen.

    I was an antiques dealer for 20 years , i sold an indian lance to a collector,the feds got me for trafficking in eagle parts which is not true to begin with,i sold an artifact he bought an artifact,neither of us would have any interest in eagle parts,also the lance was 200 years old and that is not my opinion but the feds state this.there is absolutly no connection what so ever to the distruction of eagles and any antique dealers ,and neaver will be,charged with a five year felony.
    I go to court and the judge tells me you can have a trial but the only thing you will talk about is did you sell the lance or didnt you and the jusry will be instructed to do the same-so this is the fair trial i have a constitutional right to,they know in a fair trial i would be released.then!it gets better! he states also if you choose a trial you will receive an extra 6 points over pleeding guilty -you are penalized for the fair trial you have a right to-6 points in the federal system put me in prison and not even the judge can intervene,i go straigh to prison .Extorsion in its best!!! forced to plead guilty to a crime i am not even guilty of to stay out of prison , even consulting an attorney from that town i was told yes in that court with that judge you will go to prison if you go to trial.now i am a fellon,hunted all my life and i crave the outdorrs and love firearms and also have the greatest respect for wildlife,i would turn anyone in for harming an eagle.now comes the best part,same court same agent ,two men are caught shooting eagles cutting parts off,go into this court charged by the same agent and prosecutor, both walk away with mesdomeanors and small fines ??? this is a true story and i can prove every word with court records,and dont say you can fight them because you cant ,two guys who did spent $300,000 and $500,000 and they fight you with your tax money and dont care how much it takes , both went broke and one now lives in one of those adult comunities with social security of $1200 a month ,that is what he gets for a lifetime of hard work.he commited the same crime i did,
    fear the feds and dont even think about messing with migratory birds because they come under the same laws.
    so what do i do now a good honest family oriented man who worked hard all his life and now this is my reward??? how do i get my gun rights back,right now i cannot hunt even with black powder here in michigan.

Hey everybody welcome me to the family im a felon life is very hard for me finding jobs getting pull over by cops for lil things like seat belt or lil over the seed limted y cuz felons get treat different . U guys notice that being a felon cops,bosses,goverment ,and even most of the rich people treat u like ur not even human being i know i messed up in life n i gave up when i caught my first felonie driving with sepended lic 5 times just trying to get to work and pay bills and from there on then i new my life were over with. its sad that people can come down from mexico and other places, who knows how many people they killed, and come down here and get legal n be come police officers working for government and more. maybe a second chance will come for us felons one day we all should be one n not be judge on misstakes dnt get me wrong most people killers and with bad crimes should alway be looked at that way but most felons are not bad people i can see by reading the post comments maybe we felon can come togather and instead of posting comments on here we can let the world know how we feel n some of us deserve a secound chance, buy sending our local news station letters or post comments all of us n it will get to some high like president. god bless.

  33. United States v. Bass – 404 U.S. 336 (1971)

    The above case refers to federal prohibitions. Under federal law felons are only prohibited from possessing certain firearms, not all firearms.

    Federal law only prohibits from possessing firearms that have traveled (at any time) in interstate commerce. So if you buy a gun in a state where it was made, and it never traveled in interstate commerce (by mail, fedex, ups, etc.) federal law doesn’t prohibit possession by a felon.

    Note: the same applies to ammon, but you can make you own by reloading .

  34. I too would sign it. I live in CO and have a misdemeanor harassment charge attached with domestic violence for an argument! Ive proven myself man times and even had probation dismissed early in good behavior. I no longer have the option of joining the miltary because of this BS but I work as a contractor and am about to ship out for the third time. I can work for the government and hold a top secret clearance but cant have a firearm in my house. I too would like to defend my family and house hold when needed and teach my boys how to hunt. Something needs to be done because its getting out of hand.

  35. I too am interested in this topic… I am female and currently on parole for a “felony” I plead to. First ever (49 years old)…. I basically obtained a pain medication fraudulently from my physcian….wasn’t selling them…was taking them(obviously more than I should have)…went to one doctor while I was being treated by another….and I was arrested…and imprisoned. I am very concerned about this BLOT on my social record…this scarlet letter per se…I would understand the loss of my rights while on “paper”…but after that has been completed… I should have my rights restored…the right to protect/defend myself!…..there is something wrong with this whole scenerio!!

I am 31 and was convicted of B&E of and larceny of a motor vehicle back in 1999.. i was 18 then.was a felony and my sentence was 6 to 9 months .. ok so anyway. i have been married for 12 years and have had 5 beautiful children. And not been in any trouble since then.. and that was the first time i had ever been in trouble. Well.. a few years ago me and my family went to walmart.. and my husband is a avid hunter.. and a minister on top of that… well he wanted a new gun.. and relized that he had left his wallet and ID at home.. so he said honey.. get this for me.. so i did.. filled out the paper work for a 30 30 and they called it in to the FBI and i walked out of walmart with a 30 30.. ok well 2 weeks ago.. we needed a little money for food and such.. so he sent me to the pawn store with one of his 22 rifles and i pawned it… no questions asked… anyway.. i went back to go pick it up yesterday.. and i filled out the paper work for the FBI and the pawn store people called it in and said i could not leave with the gun and that a FBI agent was going to come to our house after he stopped by the pawn store to get my info….so my question i guess is the gun i pawned was in my husbands name. Can he get charged for anything…. and can i get charged for anything… we are still waiting for them to come to our house.. and i thought…. i just could not own or posses a handgun….i never have for the record…. but anyway this has got my children scared and me and my husband are really scared that they are going to arrest me and him both. can anyone please shed some light on this for me PLEASE

  38. Yeah, you can get charged as a felon in possession. In this country once a felon always a felon. Doesn’t matter if 50 years has passed. I’ve dealt with the federal system and that charge “felon in possession” they can get you for a single bullet or being in a house with a gun in another room you know nothing about and B&E in the federal system is consider a crime of violence. Feds just ruled that motor vehicle theft wasn’t a crime of violence or they’d armed career criminal you. Their argument is “there’s a good possibly for a violent encounter” Sounds stupid but feds see it that way. My felony isn’t violent under state law but is under federal law.

    • Yeah, I had the same shit happen to me except i did 2 years in federal prison and had a state felony that was considered nonviolent (terroristic threats over a stupid phone call which i didnt even speak on that was threeway) Feds will hammer you over a single bullet like this guy said. Like what’s a guy gonna do with 1 bullet? Throw it? Funny thing is my Federal PO said i could be in a house with a gun if it was locked up in a safe where i didn’t have access to it (i.e. the key)

  39. I was convicted of a felony a few years ago. Felony stalking was the charge which was based solely on phone calls and text messages. There were no threats, assaults, or any type of violence involved. Nor was any weapons involved in the incident. The charges stemmed from the other party calling me and texting me in excess of 200 times in a one month period while the DVO was in effect. I was charged only because I returned the other parties text messages and phone calls. I subsequently plead guilty due to the fact the local District Attorney informed me that if I did not plea guilty he was going to charge me with felonies for each and every one of the phone calls and text messages. I am for fighting to obtain my gun rights back and to be able to possess a firearms for self protection and hunting once again.

  41. Hi, I pleaded guilty to a federal non-violent charge in 1979 against my lawyer advice because I had a gallbladder infection and was feeling sick. I had no idea about the collateral consequences of pleading guilty to anything. During the process nobody ever mention the word ” Felony” and I had no idea of what either a Misdemeanor or a Felony meant. I just knew that if I pleaded guilty to the charge the Assistant U.S. Attorney would have recommended probation. I felt that as I wasn’t facing any jail time that basically I had nothing to loose by pleading guilty. Too late now.
    Under Federal Law there are no mechanisms to get your Firearms Rights back. Under many States laws there are ways to get the right back but not for Federal Conviction. This is not right. I do believe that Congress and the States have no right to legislate over the Second Amendment.
    In fact the Amendment, Second Amendment doesn’t say” Congress and the States or Congress or the States shall have power to regulate this Amendment by appropriate legislation. Our ancestors in writing the Second Amendment wanted the people of each State to possess firearms to protect themselves and protect their State without State or Federal limitations.
    However, we live in a Dictatorship and Congress with the help of the Evil U.S. Supreme Court has usurped many States Rights and taken control of them without having any Constitutional Authority.

    The fact is that for a minor non-violent Felony conviction we the people loose non only our Firearms Rights but also many other rights which prevent us, Citizens, to fulfill our aspirations and pursue happiness as written inn the Constitution. The Felony Statutes be federal or State,are destroying the lives of otherwise good people who have made a minor, non-vilolent mistake in the past which shouldn’t even be called Felony as in the past Felonies were only acts of violence like armed Bank robberies, violent assaults, rapes,murders and the like and as our forefathers used to mention, treason and harboring the enemies.
    I believe that we should really organize as an organization seeking redress from this injustice and not just have a write in discussion. WE have to find a name for a website and start political activism in the name of the organization and start a writing,lobbying campaign directed to the members of the U.S. Congress and U.S. Senate,the media,the clergy. It has to be aggressive until we touch the conscience of our legislators.
    I also urge all our friends to register to vote in their own States because almost every State now grants back the right to vote to all those who are discharged from confinement and have meed the condition of their probation.
    If the politicians want our vote they have to make this right because as it is now it”s all wrong. The permanent deprivation of Civil Rights because of a non-violent conviction is a Cruel Punishment. No question about it. And then who gives the right to a few people in government, State and Federal, to control the lives of millions of people by criminalizing almost anything?
    Ten years ago I asked Congressman Charles Rangell to introduce legislation in Congress to expunge all non-violent Federal Convictions. Congressman Rangell did introduce this legislation but it never went passed the House Judiciary Committee. Evey two years he reintroduced and for ten years he did the same, Not enough support. But those evil people in Congress would pass amnesty, which is Pardon, for illegal aliens who have entered this Country illegally and used fake SS Cards and other ID Cards under fake names including fake or stolen Birth Certificates, but nothing for Americans.

    There is another Bill in Congress similar to the one introduced by Charles Rangel,this time introduced by Congressman Steve Cohen known as the Fresh Start Act 2449. This bill if passed would apply alsoto those convicted of States Crimes. However, it’s not moving despite the thousands of letters written to the Presidents and to almost all the members of Congress and Senate.
    If we form a society, a national group, then we can accomplish something. But we have to petition the State Houses and Congress and go there to demonstrate against these discriminatory,unconstitutional, evil,regressive and inhumane Felony laws.

I own a business and am a U.S government defense contractor with a TSA homeland security clearance check for delivery of flammambles to a nuclear Navy submarine base but was denied today for attempting to purchase a .22 rifle for a surprise present for my son. This law needs to be changed I am sick of living in the shadows

  43. Forty-five years ago I plead guilty to procession of marijuana for sale. Admittedly a large quantity.
    I spent 90 days in the State DOC for observation, and, due to circumstances was granted probation and a sentence of [not to exceed] 1 year in the County jail.
    The Sherriff granted an ‘early out’ and I was incarcerated 5 and 1/2 months total time served.
    My Probation Officer gave me good reports. My former Real Estate employer returned me to the Trust Accounts, and I was able to repay my debts and received a Certificate of Rehabilitation from the District Attorney’s office.
    I spent the next six years defending my Business and Professional license as a Realtor/Broker, not as to guilt or innocence but as the Justices of the State Court of Appeals found; “The unlawful act was fundamentally [an act] of Dishonesty, accordingly allowing the Real Estate Commissioner to revoke the Broker’s license; a requirement to perform Property Management, the only [honest] profession I had for most of my adult life.
    The Lawyer’s Guild filed an Amicus brief in my behalf citing the overreaching of the Real Estate Commissioner as ‘bad law’.
    In my past are several Licenses to Concealed Carry Weapon signed by at least four different Chiefs of Police. The instant matter was my only “slip”.
    I am now 79 years old. My record, save this matter, has been without blemish; not even a moving violation in my State under the Vehicle Code.
    When do I stop paying this debt?

    • You will never stop paying for it the way the legislators have applied laws. This is another means of control the government exercises upon the people. I plead guilty to arson in 1984 totaling $1500.00 in damage paid restitution. I was never told it was a felony and was lied to by the police. I was 21 years old and had no idea what was going on. I have had my civil rights restored by the Governor in Virginia but I am still not able to legally own a handgun. A time is coming when it will not matter and we as a people will have to forcibly take our country back from the politicians and judges.

  44. Now I’m classified as a violent felon for a D felony attempted possession of a weapon, weapon type not specified. My initial charge was a C felony possession of a fully loaded operable handgun in place other than home or business I am 24 years old now and I was arrested on 7/17/2008. Now I’m classIfied as a violent felon even though I was granted a VFO which is a violent felony override which states no violence took place in my crime an was granted a certificate of relief which opens up any bars I had on career opertunities except to hold political office, Now the reason for me obtaining my pistol in the first place was I lived in a bad area full of drug addicts an gang members an I had been robbed, stabbed, my jaw fractured and numerous other incidents an I got tired of being take advantage of so I decided no more an started to carry a fire arm in my car where ever I went, I have hospital bills an police reports to back up my story which ment shit in New York court unfortunately. Now the cop who arrested me said he saw the handgun in plane site but stated he took my keys off my persons an opened my glovebox an secured the firearm an won in court go figure scumbag, which is violation of illegal search an seizure. I have his statements which have plenty of contradictions So long story short I spent two years in prison for my first offense and lost all my constitutional rights which by the way is considered a treasonable act or at least considered by our founding fathers to be, now your telling me that it’s rite that I never have my constitutional rights restored completely an you say you believe in the bill of rights and the united states constitution but you believe in  gun controle and that violent felons should not never regain there constitutional rights then you a playing both sides of the fence which is your trying to be a master of two houses, you cannot advocate gun controle and support the constitution an bill of rights. If your in political office you should be impeached thrown in prison or worse  because you are in treasonous territory my friend. I will being going on a crusade to make sure all excons regardless of there past if deemed eligible to return home from prison, which means your rehabilitated or you should not have been let out in the first place that after x many years of obeying the laws your rights be restored fully. Point blank people scew up an 99% of people have committed felonys or at least misdemeanors in there lifetime at least once if there either awair of it or not everyone deserves a second chance that’s what makes this country different an the greatest in this world Freedom. I am a patriot I love my country an would die for it but some serious change has to take place or if rights keep getting taken away one at a time then there is no reason for the constitution or bill or rights, then  it’s time to have a nother revolution, I don’t believe it’s come to that extreme yet but if we keep heading in this direction it will be. By the way I’m a tax paying citizen I’ve always had a job since 14 years of age except my time spent in prison which I tutored convicted felons to get there GED, I graduated high school with a regents diploma. I know I have bad grammar skills an punctuation it is my weakness but I’m considered a genius or test scores show it in math, history and science so I don’t care about your comments on my grammar an punctuation. It’s my points that count. We as ex felons need to come together an start a petition that’s going to at least have 100,000 or more signatures (most likely a lot more) create a website site, as well as get the NRA involved we need all the support we can get to make change happen. If a couple felons whining about are rights not being restored does nothing on blogs  than we need to organize an ban together as brothers an sisters in arms and come together. A right shouldn’t be able to be taken away. There called gun rights not gun priveledges. Just because I got caught and the next man didn’t shouldn’t bar me from my rights as an American. And 3 becoming big enough that people higher up the political ladder. The N.R.A.       • i got a felony DUI also because our then govenor passed a new law 3 in your lietime . i was in no accident or harmed anyone officer smelled my breath and Bamm lost all my gun rights dosnt seem fair to me it was non violent crime Michigan sucks with all these lws > ps i havnt drank in over 5 yrs now and i attend AA regulary. i am hoping the laws here can be modified also. i was stupid then drinking and partying i didnt know my 2nd ammendant was at risk > learned that the hard way !!

  50. In 1997, after voluntarily pleasing guilty to the crime of failing to register as an investment adviser (in Massachusetts), on advice of counsel, I received a felony conviction. After 5 years, I was eligible by MGL c. 129B, to receive a FID card which will permit me to possess rifles, shotguns and ammo, BUT my local police dept. informed me that I may be a federally prohibited person, which means that although I have a valid FID issued by the state, I cannot legally have any sort of firearm under federal law. I believe that my felony is one of the few exempted from the federal gun ban under USC 18 Section 921(a)(20)(A), as it pertains to regulation of business practice, but I cannot get a straight answer, interpretation of that section, or an opinion from the ATF or the state Attorney General’s office to my question about the federal disability and the exempted crimes. Even if they do opine and inform me that my felony is exempt from the federal gun ban, how does that opinion get reflected at NCIS which is handled by the FBI? If a person can’t pass the background check, having a valid FID isn’t much good to them. Thanks.

  51. How would this affect me who was convicted of a felony 25 years ago? It was for Burglary. I have not been in trouble since I was 17 when it occurred. I served my probation and continued to live my life rehabilitated, raised my daughter and obeyed the laws of society. I petitioned the State of Missouri almost 4 months ago and already hearing good news that I have high chances of being pardoned and are recommending that I be pardoned by Governor Jay Nixon. It is now up to him, but they said my chances are good considering my story. And Missouri doesn’t pardon a lot of people. But it isn’t as low as North Carolina.

    I’ve also lived the last 12 years in North Carolina. So I guess my questions is if I am pardoned will NC recognize my pardon and all my restored rights? The main thing I wanted was firearm rights restored. I’ve never been able to own a gun.

    • I don’t know! I just heard about this last night from a buddy if mine. I was convicted of a burglary 27 years ago hear in ca. I have my best friend who is a corrections officer and one friend who is a BPD and one who is a CHP have even gone on a ride along with one of them and yes they all know my background been friends for at least twenty yrs. One of witch told me sure I could get a pardon and he would even be a character reference for me, heck they all have volunteered that but the likely hood of getting signed off by the Federal. Level would be the problem! Guess I’ll Google that one see if its been done before I believe it! PS the buddy I talked to last night saw something on tv that was stating that when Regan was shot thats what sealed the deal for me not overcoming the Federal level. The soga continues!     • Here’s a question for you: 1) How can current gun laws that are passed be applicable to these old felonies? These new laws should be enacted from the day that they are passed AND FORWARD. They would apply to any convictions after that law was enacted. How can they magically go back in time and be used to convict someone or affect someone whose crimes fall under completely different laws that were in place at the time? This is foolishness at it’s best. If the laws from the time of your felonies state that your gun rights are automatically given back then that’s how it should be.

      • What you are referring to in legal/latin is: Ex post facto. Like anyone that got caught stealing a candy bar as a kid now has to report to a store manager as an adult before shopping. A GREAT legal argument and possibly help for your cause–good luck

    • If you have’nt found this out yet you don’t need to be pardoned to have your firearms rights back. If it has been over 20 yrs . Contact your state rifle association or NRA. You will most likely have to become a member for a small nominal fee. The process usually involves petitioning the court in the county in which you reside. You make your case that you are not a danger to yourself or others,the 20 yrs has passed and that you are a law abiding tax paying employed citizen. Get a couple references. Most likely your rights will be restored. best of luck too you

    to own a firearm. He has three felonies. I understand we all make mistakes, and we should get a second chance. But a fourth chance? No sir. If you committed three felonies, the odds are you are still breaking the law.

      I am guessing you are the one that kept trying to keep my posts pulled and actually recommended felons come visit me in an off hand attempt to threaten me. It is people like you that do not need a gun. My three felonies all occurred on the same day, so I am not a repeat criminal. I might also add I have been working for one of the largest banks in NC for nearly 15 years, and will be getting my rights to possess a firearm back shortly. 🙂 I am also working to get the law changed to get the right back for other felons if they meet certain criteria. Since you don’t know me and are not a judge your opinion on the matter is not fully educated on the matter. I have been attempting to legally pursue this matter as it smacks of the unconstitutionality of a blanket ban without a method of recourse. Besides, if I were a career felon with intent to do mischief or harm do you think I would really care if it were legal or not? Most of those wishing to prevent ex-felons from possessing firearms simply do not want anyone to possess firearms, or they want to hold themselves as special individuals that have a higher right as a citizen to possess. I am a citizen of the US and have the same rights via the Constitution as anyone else. I paid my debt and have rehabilitated. You do not have the right to restrict me my god given rights.

      • Hi my names rob Serino around 25 years ago i got charged with selling cocaine to an under cover police woman i had no criminal record i was a young kid thought this woan liked me i was set up any ways it’s been like 25 years about 14 years ago i got it from a guilty plea dropped to not guilty .i served as a United States marine i own my own business for over 16 years never been in any trouble since .   54. So we all make mistakes. We deserve second chances. But where I draw the line is on repeat criminals having guns. If you have more than one felony, I have a hard time digesting the fact you should get your gun rights back. If you decided to stop breaking the law after one felony I would not think twice about it. But three felonies? I do not think this should happen.

    • I really dont know that you can pass judgement on every situation. I was 19 when I got my first felony and 21for my second. I was still a kid in many forms. I spent a year in prison for selling my prescription because I was jobless and hungry. I got out of prison and went on to get two degrees graduating with honors for my Associates and Suma Cum Laude (3.9096 GPA) for my bachelors. I went on to get 3 IT certifications all while working 3 jobs. You dont know me and you dont know my story. Therefore, “Judge ye not, lest ye be judged according to the same measure.”

  57. See: Boren v. State of Idaho. Idaho is another state who gives gun rights back to felons. Sort of. Boren has two appeals at stake here. One is that Idaho Code I.C. 18-310(4) is ambiguous and open to interpretation. The Idaho State Court of Appeals agreed, reversed and vacated his conviction. It is now under appeal by the State of Idaho.
    If this appeal fails for Boren another appeal is waiting in the wings. Appeal No. 2 would have wide ranging effects on gun laws in the State of Idaho and maybe more states. To treat an out-of-state felony differently than an Idaho felony is a violation of the 14th Amendment right-to-travel. When a felon moves from one state to another his/her felonies “move” with them. The right-to-travel guarantees that those felonies will be treated the same as similar felonies committed in the new state of residence. In Idaho they are NOT. “…upon final discharge, a person convicted of any Idaho felony shall be restored the full rights of citizenship…..” The police in Idaho have been throwing persons in jail for firearm violations because those persons have out-of-state felonies.

  59. I’m on house arrest for carrying a handgun with me on me.. I had a job as a ice cream truck driver. My ice cream truck has been threatened and I was given the pistol free by a guy who was about to rob me with his friends until he recognized me and gave me the gun..they are tellin me to find another job it is already hard enough for convicted felons toobtain employment as is.. so any job that comes my way I’m takin it. So should I ask for life in prison because I refuse to live in a society where I do not have the right to protect my own life. I have been in situations where I have been beaten by men and the police will come and tell me there’s nothin they can do because they DIDNT see it.. but they see me bleeding and hysterical and I’m tellin them who did it.. I am 4’11 female..

I don’t even personally want the right for myself but my boyfriend who has no convictions of any sort owns a couple firearms. So are we not even able to live together because of my mistake ridden past?

    • Mr Gummer is providing incorrect information. H618 is still alive and well. With tweaks it went through H Judiciary B and is now in Finance. Once it is approved there is will hit the House Floor. In fact the applicable date was moved up such that if it is approved on both sides it will be law as soon as late summer early fall. Mr Gummer, would you happen to know David Sherill by any chance? He provided false information regarding this needed legislation before.

  62. I was convicted of a robbery in Oklahoma back in late 80’s. Am 49 now. I was not in store or holding any guns. I was the driver. Would I be able to get a handgun now? I currently reside in PA now and have not been in trouble since then.

    • Unfortunately , Oklahoma does not provide for relief from firearm disabilities even a Governors pardon will not restore your rights. however you could apply for relief to the federal govt. Google “Civil Disabilities of Convicted-Felons” it will be a PDF you will have to download it. You may also look to PA firearms act you can find this through the state government web site. There may be a statute that would allow you to be granted relief but most likely not. You need to be granted relief by the state in which the crime occurred if it was a state crime. If it was federal you need to apply for relief to the ATF. Unfortunately congress has defunded the federal program that would grant relief. but, don’t give up hope and remember the 2nd Amendment guarantees the right to bear arms and if your crime was a one time non violent there is a way. Good Luck ….The right to bear arms is a God given right.

      HB618 passed the house with an incredible 109-2 vote, showing huge bipartisan support for the measure. The bill was sent over to the Senate, but due to the fact that the bill was passed on the last day of the Legislative session it couldn’t be introduced for full passage before adjournment, per Senate Rules. It did have it’s first reading which means that although it was not engrossed and sent to the Governor, it will survive as a viable bill that can be debated and voted on during the Short Session in May of 2014. There is considerable support for the bill in the Senate as well and will most likely be passed during the short session.

      Please excuse Mr Sherrill and his vacuous comments on this blog. He is a troll from CL that takes great pleasure from disruptions and mayhem without ever offering anything in the way of intelligent discourse. His modis operandi is to simply create smoke and friction and hope to cause normal conversation to devolve into flaming and baser forms of communication. He follows me like a bad penny and it is my guess that is the only reason he is here. Rest assured his input is not based in any fact or knowledge of anything of value.

I was convicted of reckless homicide, the other driver of the other car was drinking,and driving,but he was a correctional officer i was blamed i did 6 years for that every other crime I ever had was probation,I’ve never possessed a gun never had a aggravated battery ,or burglary charge. I feel like my safety is at stake as an american citizen that someone can carry,or possess a firearm in public places just because,the law allows them to,and i can’t protect myself in the same manner,they have an advantage over me,I feel like they are bullies looking to do harm.

If I am free to travel in the US without being unreasonably searched and seized why would owning/possessing a firearm make me more dangerous than a person who is not a felon that possesses/owns a firearm. There are certainly many dangers but I am not any different than any other citizen just because i have a record. I think it is just another way the mafia(our government, the most well organized mafia, if you dont pay your protection money((taxes)) takes and makes and example of you) generates mucho dinero from its terroristic rackoteering ways. the second amendment was put in place by our founding forefathers for the people to protect themselves should the government become corrupt and intimidating.

  67. Recently I was denied a pistol permit application which I wanted only for home protection & to go to the range and practice. I was convicted of a felony for marijuana when I was 18. I am now 57. I was shocked and truthfully the Law Enforcement people I dealt with on this felt bad about as well. They said their hands were tied. Now another officer sent me this link. He feels it applies to my situation.

    I was a dumb kid but it is not like I killed someone. I went on to work a career for 32 years, retired, and was never convicted of another crime, unless you count a couple of speeding tickets. I have not sold marijuana in almost 40 years. Stuff like this is nuts. At one point is someone rehabilitated? On the bright side maybe it is time for me to spend the $ and effort to get my record expunged.

About 7 years ago now I sold 4 firearms, private sale to another fellow, I didn’t know that per massachusetts law you could only sell 3 per year private sale and more than 3 we would have both had to go to a “middle man” (gun store) and have them do the transfer (it’s all about money because we would have had to pay). I was convicted and sentenced to THREE YEARS mandatory in a mass state prison! I have no prior record and have done nothing since, I’d never even seen a jail and was thrown into a state prison! Ridiculous!

    Then last year the massachusetts law changed to being able to sell 4 firearms private sale in a one year period… Which is exactly what I did, so had I done this today nobody would have even batted an eye at me… I could do it in front of the courthouse… Ive inquired about it and “because it was illegal when I did it I cant get it reversed”… so what do I do? How crazy is that!?!

    Is there any way I can not only get this felony off of my record because its really hurting my job opportunities, but also any way I can get my permits back? I live in a small town innthe middle of nowhere where hunting and shooting are a way of life. I’m an avid hunter/outdoors man, as well as used to shoot competivily, and I’ve been restricted to using my black powder guns for hunting… Which works but its not ideal.. And game I harvest is a large portion of my familys food. Not to mention I can’t go to the range which was my weekly activity before all of this. So, again is there anything I can do? It’s killing me, I’ve always been responsible with firearms, and because of some obscure law that NOBODY even knew about that’s not even illegal anymore (because it was a dumb law…) I lost my license… Wtf! The second amendment states everyone has the right to carry a firearm and that those rights shall no be infringed upon… Nothing about felons not being able to own one!

  69. I was living in Missouri: In 2000 I got a class C felony, that was for 3 DWI’s in a ten year period. I got a 3yr. sentence, served 22months with 14 months parole. After completing all requirements I moved away from Missouri and now have lived in Arizona since 2010. I’ve had no run in’s with the law in any way shape or form since 2000. I have requested my civil rights be restored from Missouri and am still waiting for an answer which wont be for another 18 to 24 months. My question is, since I have no intension of moving back to Missouri but have retired in Arizona, can I own a firearm here in Arizona.

  70. I am writing in regards to the above. I received a simple felony possession charge back in 1998 in Idaho; the case has been dismissed (not expunged). Since this incident, I have thrived to better my life, going to college in criminal justice and graduating the top of my class. My goal was to become a probation/parole officer. I work two years towards this; working fulltime and volunteering at the local office here in Buildings, MT. Yesterday I was informed that while they would love to hire me, but they cannot due to not being able to carry a concealed weapon. Idaho does not expunge records.. I am seeking out help or direction.

Even though I have NEVER beena resident of Louisiana I still recieved my pardon. I have been a native resident of NC since birth. I do not have any charges or convictions. Will I be able to recieve my gun permits in North Carolina?

    I pleaded guilty for the firearm charge
    And none of this was violent I just got set up

  73. Honestly the government stands behind the constitution. But fails to stand behind the second amendment. In life people make mistakes which are not violent, or denying someone else of there rights. Wellbeing also, but because the government saids it’s a felony, we loose our rights to bear arms. We also loose our peace of mind our security. Granted I believe if anyone cause some one else’s well-being or rights to be threatened. Then they should loose they’re rights to bear arms. And depending on the severity or lack of the crime determines the outcome of the defendant ever getting they’re rights back. Its bad enough us felons can barely get the chance and opportunity as the rest of society, the government has stripped me of my right to protect my family and be the security they need. Rather or not the picture is bigger then that is a big question we should all ask ourselves, but the only answer I want now is how do I protect my kids that I will keep them safe and honestly feel that in my heart.

  74. The ONLY people who should be denied the right to arm themselves are those who have used guns in the commission of a violent crime, period. Since the law is corrupt and justice is a joke, calling someone who has felony convictions untrustworthy of gun ownership is nonsense. Get caught with some pot? Some other victimless ” crime “? Getting a felony conviction should not be the criteria for having guns. Misusing guns should be a reason..but the real reason for such unConstitutional measures is to marginalize as many people as possible and make sure that they shrink the number of people who are able to fight back againt the tyranny we all see forming right now. The real issue is that we are empowered by the Constitution to overthrow, by violence if need be, corrupt government. Too few armed people means that we have no chance of insuring our freedoms.

    The 2nd Amenement says nothing about “..unless governments pass insane laws and label you as a felon “. It would be unthinkable to the founding fathers to take someone’s guns away because they possessed hemp ( a crop almost all founders grew and used ) or for some other insane reason. Laws with no basis in protecting society from harm and that were enacted because of corporate and political skullduggery should not be used to disarm people who have never shown a penchant for violence.Stripping people of protection, and the means of combatting corrupt governments, is simply to insure that the corruption has no real fear of being stopped. Shame on America for allowing such openly ridiculous laws to interfere with out rights.

What is even worse is that a state like Texas can create a unique “category” of felon (dwi – state jail felony) no other state acknowledges in order to make more money for ex-polititians by owning rights to sell food to the jails and prisons covered by their spouse’s family name. All the while taking away lifetime constitutional rights from someone who committed a once non-violent crime…worse the rights of their spouse and children to EVER defend themselves who NEVER committed ANY crime. Who is NOW running (truely committing crimes) this country which was great when my grandparents were alive?

    • 1991 felony dwi,revoked in 1995,of course. I still have no full 2nd amendment rights but under federal law an illegal alien charged with the same offense in not considered violent or a crime of moral turpitude can’t be deported. I lost my DL but got that back and can drive the vehicle that I got the charge in but can’t posses a weapon because I was stripped of my 2nd A rights. That’s like me committing a felony with a gun and they give me my gun back but take away my driving privileges. I say WHAT in the hell is going on? I did not hurt anyone , was at the exact bac to convict, and the arresting police officer was under investigation and subsequently fired when I went to court and no one told me. Justice is for the lawyers writing the laws,it dam sure aint for you and me.

  80. I have a violent felony conviction in Florida from around 1978. It was a bar fight. Two guys came in acting like tough guys, didn’t want to pay the dollar they lost on a pool game. Decided to grab some pool sticks and kick some butt. I cut one of them. I was charged as I was not injured and the other guy was in surgery. My lawyer wanted me to plead guilty and do 5 years. I asked for a jury trial. Eventually, I plead guilty and got 5 years probation. I did not know the difference between a felony and a misdemeanor. After less than 6 months, my p.o. took me before a judge and told him I was a model probationer, worked every day, paid my bills and was not a trouble maker. He asked the judge to let me off probation. The judge refused. About 3 months later, we went before a second judge who released me. After moving back to NC in 1985, I did get a dui 1986. In the mid to late ’90’s, a guy started using my name and got a bunch of traffic offences and other charges. My license was suspended for not going to court. I did eventually get it all settled. I have 3 pages of charges with notations saying “voluntarily dropped by DA, not person charged.” The DA will not remove the charges from my record because it is part of my record. I keep pointing out I was not the person charged. They keep telling me it is still part of my record, because it is on my record. An attorney tells me I can not get my 2nd Amendment rights back due to all the charges I have on my record. I am a tax payer, I have been in my home for 26 years. I have a good job. I pay my bills and have a 750 credit score. Justice for all. Good luck with that.

I was Convicted of criminal mischief first degree in the state of Arkansas in 2004 I was charged as an adult at 16teen I was 15 when it happened I didn’t have the money for a lawyer I applied twice for a pardon to get my gun rights back the pardon board in Arkansas granted me full pardon with merit but the governor had no contest to it it takes two years for each time a person applies I was a kid that got into a fight no weapons was used ihope one day the Law will change

  85. I was recently (last year) charged with 2nd degree assault, a misdemeanor, in Maryland for a bar fight. At the time I went to court I was currently in the process of getting transferred to North Carolina, which I had been trying to do for the previous 3 years, and was hell bent on getting out of Maryland. So my PD offers me a plea deal and says ” buy taking the plea you will be giving up certain rights like right to a speedy trial and right to appeal the ruling.” I think to myself “ok, it is not a felony and not a domestic violence I am good and can get on as planned.” So I take the plea for 2 years probation (which is unsupervised because I had previously informed them that I was leaving state and I wasn’t required to transfer with one for a misdemeanor.)
    Well I was wrong. After taking the plea it wasn’t until I was doing paperwork at the probation office that they told me that I was no longer eligible to own a firearm.
    When I went to court for the other person in the fight they had pre-determined that there was lack of evidence and threw it out before even hearing anything. Now this person has had multiple previous assault charges on him and one was even domestic assault.
    Shortly after this case the US 4th circuit court declared that Maryland’s 2nd degree assault cannot be considered a crime of violence due to the wide scope of the charge, from touching or brushing up against someone without consent to shooting someone, with no defining boundaries.

    So hear I am duped into a plea that I thought I was clear on due to being misguided on a case that they had all ready determined lacked evidence on a misdemeanor charge which the federal court declared is not a crime of violence and cannot own a gun. Yet as an airline aircraft mechanic I am responsible for thousands of lives a day not to mention 100s of millions of dollars worth of machinery.

    This is the America we live in.

      • Hi I’m in the same boat, with a non-violent felony conviction 15 years ago, & you could hire an attorney to file a “post conviction writ of Habeas Corpus” IF you were convicted within 7 years (or so, according to the atty I talked with yesterday specializing in these writs), and also if there’s a reason to challenge the conviction, such as an unreasonable search & seizure etc. Your other option that I know of is to apply for clemancy, through a governor pardon, BUT I believe all of this needs to be done in the county of your conviction. https://www.tdcj.state.tx.us/bpp/forms/FP%20App.pdf

        • under Texas law 5 years after your completely clear you can own a weapon for home protection. but not according to federal law. but you can own a black powder revolver if its a replica of a 1889 model or older

    • If you live in MO it is up for debate as of 2015 going into 2016.
      Currently the answer is NO you can’t however hopefully that will change so ling as it is not a violent felony (depending on what they deem violent).
      Federal law however prohibits for life.

  93. I think California needs to address persons with violent intention or acted crimes when they remove ones right to hold a firearm. California only wants to increase their conviction rate by making non-violent persons guilty for accusations punishable by imprisonment. That’s one of the little ways California justifies paying prison guards top $$$$’s for “watching dangerous criminals”. California can take that criminal offense and shove it where the guards keep there spouses (in the closet). I was convicted of sale of 5 grams of pot lawyer quit during my case and i was not even told about prayer for judgment i filled out all paper work and had my finger prints done for the sbi and fbi then was call by the concealed instructor saying a fed. Officer called wanted to know why i filled this out so she called my home once i told her our sheriff got me started on this process she asked if i had hired an attorney i said no because i was told after i payed my 38.00 for finger printing and 200.00 court costs i was just to apear in front of the judge to ask fir my gun rights back her answer was since i hadnt hired an attorney not to worry about the feds i have yet to pay the court cost seems hopeless i have a spotless record after all these years can you help in any way sure would like to feel free to hunt and on my firearms again thank you.

    • The problem is that the US Supreme Court, which is made up of political appointees , gets to decide what the wording of the Constitution and Bill of Rights really means . For example, the 10th amendment says that any issue or area not covered in the Constitution is a matter for the states and not the Federal government . Since nothing concerning drugs or medicine ( and many other items ) were not mentioned at all, one might think that there should be no DEA or federal drug laws .

      They get around the plain reading of the documents by ruling that since drugs can theoretically cross a state line , even if that never happens , it affects ” Interstate Commerce ” which is a category the Congress can regulate . One Justice ( Thomas ) said that the founding fathers were ” rolling over in their graves ” at the thought that a product wholly produced within a state and never crossing a state line could somehow affect interstate commerce . It is ludicrous .

      As long as politicians have agendas their appointed judges will have agendas . It is all politics .

The right to protect yourself is inalienable, not from man, but from your creator, any hindrance placed on the 2nd is therefore illegal, these statutes are illegal and unconstitutional, the right to bear arms is right, not a privilege, you would need 38 states to ratify and repeal the 2nd to place any statue or law that hinders your right to keep and bear arms.     • You pretty much answer your own question if you can’t buy guns in Alaska why would you think you could then get CCW permit? Pretty simple apply to have rights restored in Alaska. It’s a federal law so getting rights restored varies state by state. Meaning some states allow you to get restored particularly if non violent felony. However it’s still not restored on feds eyes. If you were to ever be on federal land and get popped you would be screwed. Or if dea atf any of those 3 letter agencies can prosecute you

  121. Back in 1969 i was arrested for a butchers knife in my back pocket. Non violent just carrying it. It was called ccw. That was in wyoming mich. I am 64 now then i had just turned 18. I have been told by the batf that i can buy and own black powder as long as they take number 11 caps or flint lock. These guns are very fun and are great. But like anything else the price is very high. You could buy a kit for 79 dollars but now its like 200 dollars. But i can at least have one.

      • I agree with you totally. My husband had a drug charge 25 yrs ago and recently received his pardon (complete). He served his time years ago, started back over in left at age of 40 and raised his two small children (by himself) after getting released. He worked making over $40 an hr before his incarceration and afterwards, started back making $10 with 2 children. All of this was his fault BUT he paid his debt. He is now 59 yrs old still working, NEVER drawing any free govt monies after his incarceration and now trying to get his rights back to own a gun. Anyone that has known him, knows he is a better man today than the Ocifer Spunkter that is without sin but please get the stone out of your hand. So glad to have known a man that has been way up high, had his feet knocked out from under him and is now working his way to the middle again. He touched more lives after incarceration by doing a prison ministry than most pastors in a pulpit. Judge not less ye be judged Mr. Spincter, I mean Spunkter!

          • Well Stanley, let me tell what my crime was. I’ll give you a brief history of myself. I’m a veteran of 5 years in in the US Army. 13 month tour in Vietnam 1971-1972 101st Abn 3/187 and MACV. 2 honorable discharges. Never been in trouble other than a traffic ticket. NRA member. Concealed permit holder just like you. I was an over the road truck driver for 36 years. Got divorced in 2000 and was paying child support. 2010 I got sick and couldn’t pass my D.O.T. physical. I was always short of breath. I was disqualified from driving because my breathing lung capacity was below federal guidelines. I had to apply for SSDI. It only took 4 and 1/2 years to get approved with an attorney. With my job loss I filed for a modification on my support. My oldest son was living with me at the time of my diagnosis of emphysema. My child support order was in Indiana. I live in Texas. I was arrested twice for failure to pay child support, and extradited to Indiana for failure to pay support. I was finally approved for SSDI in July 2015. exactly 61 months to the day that I became ill. I had a micro stroke in February of 2014, that’s when they discovered I had emphysema. I got so far behind in my support order, it became a felony. my crime was getting sick and not being able to pay my support???? Land of the free my ass!!!! I’m 63 Stanley. My life was destroyed because I got sick! DON’T BE SO QUICK TO JUDGE STANLEY!!!

          • Pretty Simply Put. Except…its not that simple. The structure of our legal system is designed to force people into a plea bargain. They add in multiple counts to create the one youll accept to be done with it. Now doesnt matter if that person really committed a crime, often theyll accept the plea for fear of jail or prison and take that nicely wrapped plea bargain. Certain Destiny, that you know , verse rolling the dice and going to trial and as everyone will have nicely planted the seed of thoughts that lose the trial , get the max. This happens everyday, someone accepts the deal and didnt really commit a crime at all or someone who was wrong place and time and got charged as well. Its easy to say dont break the law but what if the person hasnt and millions are victims to this, they lose rights too…so whose to decide. Right to bear arms is just that. Shouldn’t be taken from anyone because people make a choice when to comitt crimes and when things just happen. So maybe the right circumstances hasnt aligned for you while having a gun on you or you never got caught. Everyone’s who theu are at that moment and were all better off armed.

Look how the supreme court justice nominee had to go through intense humiliation form a “supposed” sex crime 40 years ago. She had no real proof.           • The way our justice system works, half the people who plead guilty are not really guilty. I have heard judges (on FOX News) say that. The goal should be to find the truth and serve justice. Not just convict.

          • In 17 years ago I was in a very abusive situation I made a very badd choice it’s still getting beat. So now I left him finally have to the 6 time of being able to stay away from him because he kept hiring private eyes to find me and making threats on my family. Long story short I have a felony charge against me for food stamps because of him and he turned me in because I left him. Yes I would love to bear arms it is my right a served my time and I paid the price. Time meaning probation but it was still something against my record I can never get rid of. Not even a parking ticket are speeding ticket ever.

        • You are correct. Many people break laws everyday and most may not even know they did or it was a law, but even if you did and paid your debt, it should end there and be given your rights back in full.

The 2nd amendment does not give you the right to bear arms and it does not say unless you have a felony. You are either Free or you are not.

        • I had a fake drug charge over 20 years ago but I got it reduced and thrown out the DOJ said no gun but the state said I can have a firearm I am concerned.

          • Yes, I was found guilty of a shooting with intent inside my home because someone I didn’t know just waltzed in and provoked a fight. Even though I had no intentions on shooting them when I saw them pick up a brick I went to the door to scare them off and they were hit in the knee. It was pure accident that they were even hit but I was charged with felony conviction and that was 30 yrs ago. I have done nothing else but work and provide for my family and now I’m told that I am being charged for having a rifle that I only use to go hunting with

        • I 2 had no parents at 16,finished school,right after high school I sold a gram of hash to a police officer for 6 dollars,I was stupid,it was 40 years ago,it has kept me from good jobs my whole life,I have bee on a roof working ever since then in south florida in the heat,I thinkbi have paid my price,the system sucks

        • It may be your right to bear, but what you do with your right can either get it taken away or secured. Becoming a criminal is definitely one way to get it taken away. Upholding the law of the land and not giving into peer pressure, is one way of securing your right to bear.

I have been in trouble for fighting and was charged with a felony after a fight with my brother-in-law in which we both got over it and he lived with my wife and I until he died with a brain tumor many years later. we took very good care of him and loved him. He apologized for the lie that he told on me to the police after the fight but the damage was already done and I was charged with a felony and had to give all my guns to my son and give up hunting which is something I loved dearly. I done my time I paid my fines and was on probation for 2 years my rights should have been restored but they were not which is very wrong we who are charged with a felony are treated as a rabid dog that never dies or find a cure and that is just wrong. We raised five successful children who all are hard-working and law-abiding citizens and have never been in trouble. I feel my rights should be restored

    • I was and passed out drunk in a vehicle i was in the people i trusted broke into a sportsmans club for alcohol and cigarettes. I awoke the next morning with police at my door saying i committed a felony…the people i was with involved my name although i was passed out and they took me home after their crime..after hours of questions the officer told me if i would just say i was there then i would be released immediately. I was not released for 3 days..i recieved a puplic defender that said if i plead guilty i would serve 20 days county and he would have my record sealed and firearms rights restored as my goal was to be a police officer..this public defender went on to become a felon stealing from my home town..he was crooked from the start..he should have had my charges dropped instantly instead of kissing the prosecutors ass…i personally got my record sealed and got my firearms rights restored without a attorney.. My next step is to recieve a governors pardon so now at age 42 i can fulfill my dream of beinga police officer at least get 25 years in on a police force…just because someone has had their rights taken dosent mean that their a criminal who shouldnt get a chance to fulfill their dream..whatever that dream may be

Now all I want to do is get my rights restored and get on with my life. I believe that everyone makes mistakes in life and should be forgiven unless they continue to keep making the same mistakes. Then no I don’t believe deserve a second chance to straighten out their life. I hope I am able to get my rights restored because I really love my guns and don’t want to have to give them up. I changed my life around and I’m no longer that same foolish person making those stupid mistakes and dumb choices. If I want to drink I just stay home or setup a dd beforehand.       • California. I got a misdimeanor burglary 15 years ago(non violent whatsoever). Just got community service. So cant I be allowed to purchase a firearm? And do I need to have my rights restored or is it automatically done after the 10 years? I read there’s a 10 year wait and after that one can purchase a firearm. That was retaining to crimes considered felony and much worse than mine so I don’t see why I would be denied being that it’s been 15years an mine was a misdemeanor.

I would love to receive my gun rights back. I love the outdoors and wish to pursue that again. I DONOT know where t begin. They say petition the Circuit Court of where I reside. Should I obtain legal council or try on my own. I am 50. I have completed my sentence and probation. Model citizen. I am clueless what to do next. I just don’t wanna petition Court and get shot down. Please contact me…8643840069….i was accused of hitting a cop, it was all a lie….the public defender won’t even view the video that shows the cop lied about me hitting him with a door and knocking him down. I had just had surgery, I now have injuries (physical ones) because hi pushed me, and cuffed me so tightly, after coming to my home in middle of night 2 times because of a girl whom I was caring for with a y7 is, and a mental age of 13, and decision making ability of an 8y.o. the video proves that he walked out turn and ran back in. I have pictures of the floor where door sticks, and it was raining. I still have to slam door to make it shut. This charge will kill any chance of me getting rights restored, or at getting passport so I can go with my new husband on the road as he is a truck driver ite. Or travel to my family’s home of origin. I’m in SC and really could use your help.

    • Excuse me, really, ok I guess it could be said that if you really are law enforcement as your title claims, then I feel as a Christian, you sir should not be in law enforcement. Your statement alone, says to me that you are judgemental, and so therefore you have no right again to be in law enforcement. When you took the oath of office, you swore to uphold the law, and I do believe in a unbiased way.Judging someone, as you have here, you are obviously very biased. I am 55 years old I am a father of two daughters and one son, grandfather of 7 beautiful grand kids. I made a horrible choice in my life in 1989, following the murder of my oldest brother, and then 6 months later, the death of my youngest brother, and then again 3 months later I found out that the person who I grew up believing was my father, turns out wasn’t my father after all. I started to use drugs at a young age, I turned to these drugs to mask my pain, I make no excuses for my choices at that time in my life, I just know that I regret that I did what I did. Sir this was 27 years ago, can you really sit there and judge me based on what I have said here, there is no more to my story, I have simply stated what I did. It really angers me when we live in such a judgemental, hipocritical society. I am asking for my rights to be restored, so that I can go hunting, I have no interest in owning a handgun, but just based on my conviction 27 years ago, I can’t do that today. So you sir I hope someday you will be able to get over your very negative view of people who have had past convictions such as mine. WE ARE NOT ALL THE SAME, judge not and ye shall not be judged.

      • I’ve been reading different people’s individual stories on here, and I’ve got to say that my temper has risen and fallen several times with several peoples stories and responses.

        Our Government is not always set up to be fair or un-bias….remember that our judicial system starts with the police officer “a normal person who ends up dealing with a lot of bad things in his career”..then, based on his decision at that moment in time, it could escalate to a Judge making a life long decision on your future…based on….an Attorneys story telling ability…the same Attorney who in essence is trying to become a Judge and some might say is actually working for the Judges they present their cases too, because…they require recommendations as they try and climb the ladder to the “Untouchable’s” in our judicial society…

        It doesn’t matter what your felony is for and if it did, it might or might not count depending on how much money you have and are willing to give to that same judicial society who screwed you in the first place.

        Judges and Attornies are caught every day by hidden camera, other Authorieties..blah..blah..blah…
        but not much happens to them…most still get their retirement, or the payoffs they received…most just have to quit their current job and for some…they actually go right back into their tarnished profession either under a new job title or something as simple as a new location.

        The problem here my friend is…..”Your willing to participate in this corruption by asking their permissions for what is your God given right!”

        Do you really think that everyone who carries a gun to protect their families are legal to do so? Do you think those who are…haven’t broke the law in the past?

        Stop letting these types of people control your life…..

        If you feel you need a weapon to protect yourself and your family..then get one! It doesn’t matter how or where.

    • That’s a very ignorant statement. Many people are convicted of “non-violent” felony charges at a very young age and many years later…let’s say 10,20,30 years later, they should have every right to petition the state to get their gun rights back. Too many people assume that just because you have a felony charge that it’s for a “violent act” when many times its for things such as theft or property damage. Point being…I think that a 48 year old that was charged with felony theft, at the age of 18, should be able to petition the state to have their legal rights reinstated. Let’s be real here, most “criminals” or “people who want to perform criminal acts” don’t care at all about petitioning the state or having any legal right to carry a gun. They just go out there and buy one off the street. Noone is perfect and therefore I firmly believe that each individual should have the right to petition the state for reinstatement of their gun rights.

Now he has not been in jail since he was 20 and then at 44 years old He thought he had his rights back but no the ATF who suck come in an arrested him for calling the gun in and gets 2 1/2 years. That is what kind of lawman we have. To make things worse we had cameras in the office and you can see the ATF only look at the computer and my daughter worked at Hooters and the agents were throwing pant hose at each other and one was sniffing the Hooters calendar. Believe me this is all true. I have the disc to prove it. No other room was searched.Just that one room and The AFt Mr. E—-k was all so acting mean to me. Our justice system sucks. My husband get over 2 years but you let someone hit and run they just get probation.

    • You should look around you. Consider that around 50 percent of all men have had some kind of criminal record. If your brother, sister, g/f or wife had a crime on her record from a quarter century ago would you hold it against them for life? Unforgiving are we if you say yes. I had been convicted of a crime when I was 24 years old. This is now 30 years ago. I have not had any charges since then. I hope you had a ticket in your life and you were counting on someone to forgive your ticket after 3 years. Never happened? Ever had a friend defend himself and get caught in a crime for it? I am sure you are so perfect that you and all of your family and friends never committed a sin or a crime in all your life. I know for a fact that I deserve my rights being restored. I havent tried it for a while but I am sure they wont even find my record since it’s so old. I will be getting firearms again. I also may be able to defend myself with air powered rifles. There are some very powerful devices made today. But, This comment you made is ridiculous. Once a criminal always a criminal. That person is less likely to commit a crime just because they have there right reinstated, Oh but lets give the twenty one year old sweaty guy a gun because he doesn’t have a felony YET!! Look, I understand better than most , the struggle in being a felon , I received a felony 20 years ago for possession of amphetamine, not meth but it might as well have been. I didn’t go to prison just 3 years of probation After that I began teaching and working in rehab across the country I have a Masters degree in psychology and a BA in Biopsychology .and I still have a felony in Arizona. LOL My point is we are not a perfect nation nor do perfect people exist. But I would hope that people will still judge me for who I have become rather than the mistakes I made 20 years ago.

      • I. Agree, I am a convicted felon, in 1986 I stabbed and killed a man that molested my son. I served out a 12 year sentence. I did my time, I worked till I got diagnosed with bone cancer, now I am trying to finish my life as calmly and quietly as possible. It’s been a long time since that took place, I still get problem when I get pulled over, or just applied for loans or jobs,whate wha. I don’t feel I was wrong exept in the fact that I went out looking for the person,was was plan to kill him,but it happened and I don’t feel sorry for him.     • I am 45 yrs old I have served on a fire department and ems service have never touched drugs since I was 18 yrs old I experimented with pot. I had just turned 18 I was traveling with a 35 yr old adult when we got stopped in Texas and we had 7ounces of weed in the car. They slapped me with a felony possession charge, never been in any trouble in my life, yes I screwed up but I am not a hardened criminal or druggie or dealer and I have more than paid my price rather unfairly but I have. I have a family I work a great job and I want a firearm to protect my family. So u still think after all these years of doing good over a semi petty offense that I am still a criminal?

      Let me give you a quick scenario or “my story”. I have my own construction business and am a sub contractor. The general contractor skipped town with over $100 K, of which $14,000 was mine. I paid my employees out of my own pocket which left me with nothing. I needed a little money to get me by for the next 10 days till my next check. I thought it would be a good idea to photocopy a $20 bill and buy groceries. I got 18 months for one count of forgery (Nebraska – Bryce Miller – 84044) and am now out on parole after 9 months. I’m an avid gun owner/collector or I should say I was.

      I just have a hard time believing that for the next 50 years of my life, I shouldn’t ever be able to touch a gun.

      • You can receive your gun rights when you petition the courts. Check the law out for your state. NC law says after 20 years with some other stipulations to get it back.

Becareful how you put down others, I’ve worked with prison systems and seen many of all of the above members of society imprisoned for the most simplest of mistakes.     • As a professional and successful man, I have been living with a daunting felony conviction….

      In 1984, my 18 month old child sustained an slip and fall injury in the house. His injury was not clearly understood by my young-self and his young mom. By all appearances, he was alright. I went to work and was called home 6 hours later about a traumatic change. As much as we all tried resuscitation, including paramedics who arrived after I did, my son passed away.

      A kangaroo court was quickly arranged by a redneck sheriff, who did his best to discredit me with a terribly incorrect news story. Yes, it was an election year. My lawyers and I decided to let the prooving of guilty lay with the DA and did not put me on the stand. I was already angered with this faulty system I was experiencing. After the trial concluded, the judge met with my attorneys and confided that my verdict from the jury would be returned as not guilty. He was wrong. The sensitive jury was sold by the DA’s harsh closing statement and declared me guilty of Involuntary Manslaughter by ‘failing to provide timely medical attention’! What??!!

      My attorneys thought it cute to quote me $10,000 for Apeals representation. I was not only young and learning, but not rich by any means. My sentencing hearing was presented with several character witnesses. Some being cornerstone professional adults. Honestly, I believe the DA was embarrassed. The Sheriff of course was satisfied. My sentencing was 5 years suspended with probation. My probation officers through those five years went on to being my best friends even through many years since.

      So my question to you, sir, is how does this law change your thoughts in my case, if any? Those that know me, know that they would be beyond reproach if they ever thought of me as criminal.

      It was a very unfortunate experience to loose my child. In reality, I was the victim.

    • Yes I made a couple of bad chocies and went 2 prison 4 both of them..then I join the armed services..my f.b.I. check came back they decided 2 keep me instead of discharging me…that was 36yrs ago..now I’m a 100% disabled vet…so tell me why u think I shouldn’t b able to arm and protect myself? Especially since the government didnt seem 2 mind when it comes down 2 defend this country

I say ‘privilege’ because as a convicted felon, I believe that it would no longer be a ‘right’. I have known many people hath made bad choices when they were young and have never have had so much as a parking ticket after their first offence. So I made a mistake when I was 19,I’m now 38,and haven’t been in any trouble since,and Noone from NC can help me get an expungement,due to their laws. Not every black man is a career criminal,jail prison,isn’t for everyone. There are good people out here who made a mistake,and needs help, but noone wants to help, just criticise and point fingers.       We are all young and dumb at one point in our life, clearly some more than others. I now can protect my wife and kids, myself and OUR property. We both pay taxes and I also can vote again. I hold a very high paying job, and work my ass off every day.

    • It was 30 years ago, my father just died from cancer, I was 17 with a piece of crap car that could not pass inspection, I was making $5.75 an hour working 20 hours a week and going to high school, I altered my inspection sticker and WHAM I am now counterfitting, too young and dumb. FELONY CONVICTION. Public defender was dumber than me and now I am paying the price. I have 2 children, a wife, a house, a 21 FT. boat,a U.T.V. and a full time job making good money, why should I not be able to get an F.I.D. ?

    • I was 18 I am 45 now I got caught with a little weed and was convicted of a felony, mind u I’ve never been in trouble prior to that incident and have lived a very productive and criminal free life ever since. I have worked in email and even ran my own business and raised a great family, I’m sorry one small mistake that gets u labeled as a felon doesn’t mean you are automatically a horrible person. I didn’t make poor life choices, just took charges for my ex husband so he didn’t get kicked out of the military!       I’m 45 years old when I was 18 in was convicted of accs after fact to grand theft 2 times.
      Because a friend told me he was gonna steal some cars.
      He did.
      3 days later I was arrested
      I wasn’t involved nor part of it.
      But because he said it and I knew even though I thought he was talking shit. Wyoming charged me. Now I have 2 felonys on my record.
      I’ve never broke the law. Urs a crappy law in Wyoming. I can’t go hunting with my kids now.
      So unless you understand I wouldn’t open my mouth n start getting upset at all felons.
      I could post on here and tell you I’m going to rob a store. Now if I do Wyoming going to come arrest you as an accessory
      So now you better hope I’m joking. Or your gonna join the felon club.

      I got a passport. Took my kids to Canada for vacation. Halfway through are trip… I was kicked out of canada by border patrol after I drove from wa to Alaska border. Had to turn around by Alaska Canada border and drive home. Stupid shit. All because of a dumb law in Wyoming as a 18 year old kid. There law is guilty.guilty guilty. They charge anyone who knew even if I told you and you told your friend. We all 3 would be charged.
      Just saying. Not all people all bad.
      And yes there is wrongfully accused felons. Rare but they exist. So you can’t toss it out as a few of you have said.

    • I use to think that way but now I got my rights taking away because I was with someone that was making bad choices and I didn’t know about it until I got called in the office and now I am on probation.     • Okay This is an old post but i want to share.
      In high school i put myself in a bad group of people and made very poor choices. I started to not care about my future and more about the popularity points for the present. Everyone I hung out with took Pills so that became a factor in my life. soon after that turned into the only thing i cared about in my life. Once i started i could not go one day without or i would be in excruciating pain throwing up, hot and cold flashes, or on the toilet, it was the flu that didn’t end. Mind you this was at age 16. I worked but could not hold a job unless i had pain killers to get me through the day so yes this leads up to my crime. I cashed bad checks in a close family friends name for 300 dollars on two separate occasions. I was so desperate i didn’t even care if i got caught i signed my own name i just wanted to feel better. After she was notified that i had cashed them my mother took me to her house and i apologized for what it was that i had done. The next day i was put in rehab for 14 days. Two days after i was out of Rehab the state police picked me up and put me in jail they tried me as an adult at 17 and succeeded. I was unable to finish High School and spend 38 Months in prison.
      Now before all of this happened in my life i worked on a farm bailed hay every weekend and on my spare time went fishing and hunting. every year dad would take me and my brother up north Michigan for two weeks for gun season. I am now 26 years old i and a Fiber Optic Technician that travels heavily for work on renewable energy projects. I have a beautiful wife that works as my partner and two Australian shepherds. My hobbie is still fishing and hunting. I am a dedicated bow hunter and enjoy every bit of if. I know i made poor choices and i agree 100 percent there are alot of criminals out there that DO NOT deserve to have there privileges back. But i do think there should be a chance for people that made poor choices at a young age. Everyone has there opinion but not everyone is a saint. Everyone has gone over the speed limit at least once. you just haven’t been caught.

    • Sir, there are many variables to consider there, and one is the crooked law enforcement factor, and some departments will charge someone overly excessive to try to get them to work for them, or in some cases to generate revenue for their local department. I knew someone who went to a womans house to fix her car for free bc she didnt make much at her factory job, and her lowlife son begged him for a ride down the road to a store to get cigarettes, and he was kind hearted so he took him, when he got back and walked across the yard and resumed work on the car, detectives came out of the bushes and arested them
      both bc of a shoe box of marijuana that the son had laid out drying in the edge of the yard, and even though the son admitted it was his, and they could clearly see that it did not come out of the vehicle, the good samaritan was charged with felony possession, (they also listed each mechanics tool as a weapon, ensuring he never gets his rights back inder the 20 year provision) and was threatened with a conspiracy charge that carried five years if he turned down the plea, he was picking a jury with a court appointed lawyer, but due to all the lies already told, he got scared of doing 5 years for something he didnt do, and figured the 6 month suspended sentence for the other guys 1.5 pounds (of tops and leaves that were stolen by the son somewhere in the woods), wasnt as bad as the 5 years, and with loars wearing badges that would testify against him out of anger bc he refused to hang out with criminals and wear a wire, he was afraid to fight it, and he lost all his rights, that was nearly ten uears ago, he cant take his young kids hunting bc they cant draw a bow, he cant be part of school finctions with his 5 kids, and he is a Christian man, but I guess he is a bad guy for fixing a womans car for free and giving her lowlife son a ride to the store, right? Or is it bc he refused to hang out with criminals he didnt know to wear a wire and bust them and make the detective’s job easier? I dont know, i guess each of those is reason enough to lose ur rights in the eyes of some people, but these days, they make nearly everything a felony, if u bring a cigarette in ur pocket by accident to visit an inmate, and dont give it to nobody and get caaught leaving with it, thats a class I felony, and in America, u shouldnt lose ur God given rights protected by the constitution, only God can remove thise rights, if u want to get technical, the firearms acts are all illegal, how stupid can a person get if they dont get the meaning if shall not infringe? Dont irry though, u may find urself in a loophole one day for virtually nothing, and then u can see what a life sentence being a convicted felon really is, as a mayter of fact sir, with all the ridiculous laws on the books, u have probably commited a few felonies this week too. I slept underneath bridges from the time I was 11 years old until I got out of prison in 2013. I begged for change from ppl to eat or go to the local ymca for a shower. When asking begging and pleading for change didn’t work I had no other choice but to go steal. I am not proud of it and I definitely won’t ever do it again after experiencing prison. But I went to churches looking for help. My own dad would not help me because my mom started cheating on him and he cared more about what she was out doing then if me and my sisters were ok. I was always sick from not eating or being able to shower or get medical help having infections. Do you know on July 27th 2017 at the end of my work day I started feeling sick. I went home and the next morning when I woke up I had no hearing. I’ve been sentenced to silence. Man that’s the worst thing in the world to not be able to hear your kids voice. Or your wife’s I love yous. So I’m not asking you for putty but that whole thing about once a criminal always a criminal. That’s your ignorant train of thought. I’m changed. I’ll never be on that side of society again. Why do you think I’m looking it up in the first place. Because I want to do it the rite way. Shit if I still thought the con way I would just go find one off the streets. But that’s not what I do anymore. I’m not above the law. Im equal just like you buddy.     • Well some of these criminals… save the lives of you and your loved ones… I honestly believe that if most people are honest… They have committed a crime that could have their rights taken, the only difference is I got caught as a young man in a civil case that some how went to a court of law… the detective told me I will go to jail for a year if I don’t plead guilty… Now I’m sure that you know everything and have never been scared… but as a 20 year old that had never had anything other than traffic violations, when you are arrested for misapplication of property because I was told where by the home owner where to place the fence and wants you to move the fence back over the property line for free it was aproxamatly 6k worth of work and materials I could not afford to do this.. so went to jail bonded out showed up for court and was told to plead guilty or you are going to prison… what do ya do… I am a paramedic licensed by the state and by the national registry… I would really like to have my gun rights so in the event of an active shooter situation I would be able to save my ass and yours.. Not trying to be an ass, but don’t put all criminals in the same catagory… BTW this was over 20 years ago… I will not give up until my rights are returned to me.. I feel that they were unjustly taken from me… I vote I sit on juries I am trusted to save lives why would I not be trusted to carry a gun to help me save lives in extreme situations??????

Latest was a 50 year old woman who’s grown son was driving and unbeknownst to her had a bundle of drugs/semi automatic weapons in his car. Despite her Son telling the truth his mother was convicted of felony charges and received 5 years supervised Probation! It happens far more than folks realize.

People who have committed crimes and who are doing well by maintining a job and paying their taxes and commiting no new crimes should have the same rights as others.     • The truth is I am a felon as well and I’ve been out of jail since 2001 I committed my crime in 1999 I was 17 I made a mistake I got home in 2001 finish my parole in 2003 never got any violations on parole or anything of the sort never went back to jail ever since I have two beautiful babies and my life is on the right track though it’s hard but it’s on the right track to all of you to say once a criminal I paid my debt to society I was wrong for what I did don’t judge people for the rest of their life just because they made a mistake in fact when I got home I became a doorman and worked there for 10 years I moved to California now and I’m doing great I have my own business but life moves on people for those of you who are stuck I’m sticking it to people like myself because they made a bad choice in life don’t be so judgemental learn to forgive

    • I have a delivery manufacturing felony for sharing a joint which is wrong on every level. No reason I should have lost my rights so I have to disagree with you. Someone that got a felony that involves violence with firearm on the other hand I would agree. If the felony wasn’t due to violence should never lose their rights, it makes no sense at all.

I clearly made a choice not to take the State’s Plea Bargain of “Time Served” to take Ten years in prison and spent every day in there and that was my choice to loose a career of 16 years in the oilfield and homes businesses and my Children for what I believed in . should I be prosecuted for something I had no control of by your standard

    • I just love how people, cops, high and mighty God fearing people get up here and acted like they have never made a bad decision in their life. When I use to do drugs when I was younger I did them with people in my town that are now the judge’s, lawyers and officers on the force. So I love to hear all these commits against a man being able to defend his life when someone breaks into his home to kill him and maybe his family. All because maybe he or she has a drug falony from years before. And now 7 or 8 years later they have changed their life, paid their debt but is still being punished.     • As a convicted felon from 40 years ago, I turned my life around. I work with folks in need of rehabilitation and I have worked as a district manager of a large food corporation. My life from 1978 to now is absolutely clean and I do not deserve those words of “Once a con, always a con.” I made mistakes, learned from them, and probably live a more honest, compassionate, and caring life than some of the folks that made these negative comments. I am not a “hater” and refuse to be put down for something I have paid for and moved on from. So, I have the rights of any law abiding citizen and i will exercise those rights in an honest and fair manner. Who else can adhere to that?

    • 6 years ago I was thrown in federal prison for 9 months for a crime I did not commit and in that 6 years have not been convicted of any crime because I am not a criminal. I am just as much a victim as the people my sons mother was stealing from and a victim of people like you telling me I have no rights though I had to pay a debt to society that was not my own. What am I supposed to do when some meth heads decide to break into my home and kill me and my family for whatever reason am I supposed to wait for officer D Head to show up when it’s to late. Talk about wtf. Where is my justice.

      I have “earned” myself a felony 10 years ago when I was 19. There are such things as scientific studies proving our brains are not fully developed yet to make healthy decisions and realize what our choices that we are making will negatively affect our future. Our executive center (aka “decision making center”) is shut down and we make choices/decisions solely based off of impulsive behavior because our brains are not fully developed. This will not happen until we are approximately 25 to 28 years old.

    • WOW! I committed a crime when I was 19, but I know that the law is not fair. People like yourself who want to look down on those of us who broke the law and got caught. I have not been in trouble in 30 years, but I am more than willing to bet my freedom against the chance that you did something in your past that could have left you on the other side of the law. You may have had a good lawyer or just didn’t get caught. It’s still a crime even if your lawyer kept you out of jail or you were fortunate enough to escape the charge because you’re friend lied for you or your daddy paid a lot or money to make it go away.
      The law which banned X criminals from ever owning a firearm isn’t about the safety of others, it’s about keeping those persons in the criminal mind-frame so that they are more likely to get caught with a weapon and prisons are able to make more $money$ off of their incarceration.

I was convjcted of assualt on law enforcement after spitting on his boot for physical and verbal abuse i suffered from this cop. Now ive been to prison 2 times for possesion of a firearm that 7 years taken from me for spit when if he was not an officer i had every right to defend myself and should b allowed that right whennofficer was abusive and out of line. Now ive had to suffer im not a mean person i cant hunt with my son i cant defend myself against the gang control in my hometown why. Ive never been in trouble for robbing murder rape kidanap just firearm possession and assault. This country is so rigged.     • 1 in 9 adults in this country are felons. More than likely everyone has committed a felony without knowing and with no intent on committing a crime. We have almost as many people in prison in this country as the rest of the world combined.
      Before the 60’s almost all felons got their rights back once they completed their contract with the court. Unless you’re convicted of a violent felony you should at the very least be able to keep a firearm in your home for defense. And you should be allowed to hunt. It’s actually a constitutional right to self defense with a firearm.

  129. In reality, imprisonment is a way of paying the price to society and restitution. Once you have paid your price and allowed back into society the government has decided you are ok to go back into society. All rights could be reinstated. The 2nd amendment does not say we have a right to bear arms…………unless you once did a crime or are a nut case. Gun owners scream registration and confiscation and hate any laws of any gun control. “That is not in the Constitution”, they cry. But banning ex-cons from having a gun is not in the Constitution yet we embrace the concept. So criminal’s have either paid their price to society and could be reinstated with full rights or keep considering them as criminals with no rights. I feel the law forbidding ex-cons from having guns is good even if it is not provided in the Constitution. That said we should stop accusing the government of making any laws to be disarming us so they can set up an unlikely tyranny. Stop the paranoia.

I have served 5 years and 9 months in the incarceration field, since then, I have been out of my dark times, and I have been in the light of peace and avoided trouble. I am looking forward to restoring my gun rights and the rights to go outside of the United States for vacations.

  131. Grew up with amazing parents. Taught me right from wrong. High achieving student through my sophomore year in high school. That summer I got mixed up with a crowd that started me on meth. Ended up with some misdemeanor charges as a minor from the ages of 16 to 18. Caught a burglary charge at 18, for stealing some tools out of an open garage, to buy meth with. Caught a petty theft with a prior for stealing a bottle of booze to try to come down off the meth one night, at 22 years old. Got out of prison at 23 years old.

    When I got home I knew that I couldn’t be around my old friends. Moved away with a great woman that I met. Worked for a landscape company for 4 bucks an hour for 2 years. It was small, and I bought it from the owner 2 years later, when he retired……he let me make payments. I grew the business and made a decent life. Eventually left for a county road department job, with all the benefits that a government job offers. I took their sign and traffic signal department from the cave to modern days. Became a foreman within 8 years and am on track to be the Roads Superintendent when the current one retires in 5 years.

    Raised 4 wonderful children. Have 9 awesome grand children. Been with the same woman for 24 years. Own my own home. Volunteer my time and money to my community, and am well respected here. But even though my felony crimes (non violent) are 24 years old, and I have been a completely different person for all of those 24 years, I still can’t own a rifle to go hunting with my friends, or a hand gun to be able to protect my family in my home.

    I understand the need to keep guns out of the hands of dangerous people. But when a person has clearly put their past behind them, I believe that they should have their gun rights reinstated. Far, far more “dangerous” or irresponsible people than the man I have been for the majority of my life, and am now, are purchasing guns today.

How can I get the paperwork showing that I got my resume lights reinstated from 1985 or 1986 my dad has then passed away and he’s the one who filled the paperwork for Mr and all I did was signed it but ever since my dad passed in 2997 my mother throughout all if his paperwork and now that I’m a Pastor I need to get my concealed carry because I have been threatened people and they need proof that I have my rights reestablished and don’t know how to get the proof can you help ?

  134. Hey you guys with fed. convictions, a bill giving the ATF funding to process the applications for firearms restoration passed the House in 2015 but was shot down in the Senate. You should all contact your Senators and ask them to vote for any bill that provides funding to the ATF for this purpose. There are several million non violent felons in this country that have this same problem but very few are doing anything about it but whining. They all know it is wrong and unconstitutional but nothing will change unless you make some noise. Get off your butts and get some letters and phone calls to your congressmen and senators if you want to get something done about this. Remember there is power in numbers so it is just a matter of getting everyone to work together.

  135. I spent 7 years in the combat zone as a military contractor. I have been hurt twice as a result. I spent over a year on a military ship as well. I just got hurt bad on the ship. I haven’t been in trouble for 35 years. I have a secret security clearance. That said, I never hurt a sole in my life. I can not own a gun. The law is made for the rich. Not the working class. I should be a poster child for restoring gun rights.

  136. We have The Bill of Rights, the only Rights we have whether you are in trouble or not it is imperative to know them and keep them. Where does it come to be that those Rights which are needed in the courtroom are taken away as part of punishment? After paying your “debt” why are Rights still denied? Does one lose the Right to express themselves if they say they are going to harm someone? Why is the 4th Amendment requiring of a warrant to search a person’s property also an excuse to damage the property? And also allows a flash bang device, which can be deadly, to be used? David Koresh could easily have been arrested on any of his trips into town but ATF opted to raid the “compound” in full battle dress and take many lives in the process!
    Free speech, defending ones life with a firearm both require permits, permission to exercise a Right makes it no longer a Right. Peaceable assembly quickly becomes a riot when police show up in riot gear. Citizens are not allowed to wear body armor. Police are allowed to lie to you. Lie to police and you have broken the law. You have the Right under the 5th Amendment to not speak to or answer any question from police so why do police have interrogation rooms? Because they know most are unaware of the Right and it shows a complete disrespect by police for your Rights. No one in custody of the jail or prison system should die from anything other than natural causes yet inmates are killed all the time or die from being denied needed prescribed medications. The staff and administrators are never held accountable. They do not protect you either.

    A quadriplegic wheelchair-bound man, the injuries resulting from an auto collision, lives with his wife and children. His home is suddenly raided by DEA agents after a short investigation and surveillance. He arrested for having too many opium based pain relievers. It was his prescription but he had not taken enough of them! They decided he was maybe going to sell the extras although there was no proof of that He served 8 years.

    All the self-righteous anti-gun commenters responding to this article of rare cases and misconceptions best pay attention to their own business because the misuse of law enforcement is far more common and deadly. Also nobody is punished for fatally shooting an unarmed man in the back as long as the shooter has a badge.

    Ten Rights guaranteed are what you all need to work to keep intact. Taking Rights from some leads to the loss of them for all.

Hi all I know is I’m paying everyday for my past I got a few DWI one was a felony I did my time did all they wanted me to I got a hardship license drove five years without a ticket they reenstated my driving privalege then I went another decade without any trouble never drank or anything then I had a crises the place I was working was relocating four hours away at the time I had a new house my own vehicle I was raising two boys at home and this division I had to make had me overwhelmed but anyway I decided to relocate to keep my job to keep insurance for children I let them stay with Grandma so they could stay in same high school and graduate but in mean Time I was driving back and fourth trying to keep things together well the stress of driving and not knowing what I should do took its toll on me,so I was driving from OK city to in mo.i was so tired I couldn’t stay awake I was frustrated so I made wrong decision low and behold I was on phonedidnt realize I was going ten miles over speed limit got stopped but I wasn’t drinking at all but he wanted to draw blood officer said if k didn’t he would keep me in jail so I did and after twenty four hours they let me go but I plead guilty to a misdemeanor but it got me 10 weekends in jail 900 dollar fine attorney feesthey didn’t say anything but after all that I get a letter saying I could never drive again and can’t own a gun, after 16 years of never hAving accident never shooting anyone for the rest of my life I can’t protect myself and can’t get around like normal people to keep Aman down like this is crimanal I’ve paid dearly for what might have happned good luck to all those fighting for rivhts

I got a good story & some of you aren’t going to believe what I’m about to say but believe me it’s all true. 26 years ago I got charged with not getting permission from the IRS to manufacture an explosive. I am a Marine Corps veteran, & I figured what I do in my home is my business, well not. Especially when my exwife made it the police business with her lies making her out to be the victim. Well that went on from 1988 till 1990 in which time I purchased a single shot shot gun to go hunting. Well she got in touch with ATF after she left me & ATF surrounded my house & arrested me & on their way through they stopped & arrested my ex as well. So we went through all the finger printing the whole nine yards & she is there telling them about my scars & everything & one of the agents said she knows what she is doing. See she changed her story so many times. Any how I got assigned a public defender that knew nothing about criminal law. Plea deal didn’t happen but if I stayed with my not guilty plea they were going to set her free & then use her & her girlfriend to testify against me. Yes they can do that, they are ATF. So I changedd my plea to guilty because I wasn’t going to let her get away with anything. Because we were not to have contact with each other at all & she broke that bond many times but they did nothing to her. I got 9 months federal time & she got 8 months. Well I did my 9 & was released to 3 years supervised release. My ex ended up with 6 more months added to her time. Got my divorce immediately after I was out. Haven’t been in trouble since. Not a criminal to begin with just made poor judgement. So 26 years later my wife & I are being poisoned by people thinking & believing some want to be drug lord or whatever. We had to leave our apt in Pa, I’m talking about all our belongings furniture motorcycle that I was almost done building everything. Grabbed a few clothes our meds & paperwork & got out of the state. Went to Ohio, well it followed us, because they compromised our phone everything. Now in Ohio one of the blood test showed arsenic in my wifes blood. I don’t have no insurance just the VA & I’m not getting anything done there, they want me to see a shrink. But nothing happened. been in touch with the EPA in Pa, my wife even had a nurse coming once a week & they were effected by the poison, so the board of health was doing anything, Got in touch with ATF & nothing there. Now my wifes medical records have been compromised in PA & Ohio. The board Of health in Ohio said best thing for us to do is move because it’s hard to tell what all poisons they are using. So now we moved to S.C. & were here for 4 days & so called friend of mine & his wife got us hooked up with this trailer that we are at now. no heat, landlord was suppose to get baseboard heaters, that was in Jan it hasn’t happened. Have had people on the roof underneath the trailer. We continue to seal & nail skirting where it is loose. Now the landlord put a blind up in this half done garage that has an unfinished upstairs to today. So we got the guy across the streets that plays on off with his lights or beats on a drum out in his yard that looks like a junk pile. We got in touch with the FBI the other day & can’t get nothing done. So I hve no option but to make me a shot gun, I’m going to give a warning shot & let them know the next one is for them. Got no where to go because everyone that I have found wants an application fee & background check. NO felons! So what we supposed to do, just sit & let them kill us? Because I know when I shoot one of them they will arrest me because of me having a record & they won’t even bother with an investigation be cause the law is lazy. My wife is covered with all these sores on the out side of her body I get some but not as bad as her but our insides oh my the stomach cramps excessive sweating, bones hurt & I’m going on 59 done had a hert attack & got degenerative joint disease, my wife has heart problems & osteoporosis. All of my teeth have fell out because of this I only have 4 left on the bottom & 2 of them are getting loose. That was another thing the board of health said too in Ohio, this is rare. Oh no it’s not. It is a major thing now, just don’t hear about it on TV. But you tube check out arsenic gangs, gang stalking it’s every where. Arsenic gangs is a little differant because money is involved as little as $50 bucks, all age groups. there is one in florida that went through it for 10 years & the neighbors even had block parties. They were getting off on what they were doing to this family. Broke into their home poisoned their food & bottled water which we have had that done too. Can you imagine how pissed off you would be to just grocery shop. go away & come home & realize your food is poisoned & you got to get rid of it & buy it again. I can’t tell you how many times we had to do it. even changed locks, but learned a lot about locks on you tube. Your best locks are grade one. They cost more & being on a fixed income it makes it hard. Our car plate expired dec 31st 2016 Haven’t been able to get it done cause got to pay property tax on it & we just got it 2 years ago by the grace of God. But going to get it done this friday & get my license. My wife is staying home, afraid to leave the home again just like PA & Ohio. I had to do the shopping & everything & she stay at home like a prisoner in your own home. So what do we do.? I admit i did a couple of things at age 15 that caused me to get a non violent Y.O and a misdemeanor but that was 30 yrs ago ,and since then not one time have i ever been in trouble for anything not even a traffic infraction .. i have a family a home like every red blooded American, pay my taxes i am a fireman and peace officer in my town and was still denied a fire arm to protect my home or even hunt if i wanted to…people may agree or disagree with some of the comments left on this blog but the fact of the matter is everyone should not have there 2nd amendment right taken away and be re-evaluated.

I have a family raised 4 kids and have been in no trouble other than traffic tickets in those 30 years am I eligible to be re instated? If so can I apply for that in Oregon or must it be in NC. Also how do I start the process?

Well in Texas once you been of parole you can have a gun in your place of residence once 5 yrs. has elapsed in other words off parole and probation, but not legal in federal law but ive been off 8 yrs. and i keeps me one in my house for my protection i don’t give a fuck what law it is if i shoot might not find out but that fool broke into my car and apt. got shot.

  145. I don’t totally agree with the previous comment the gentleman wrote. Because I caught my felonies in Tennessee and received a six year sentence which I had to flatten. I went when I had just turned 21. I am white as you call it sir, and the population at south-central correctional center was pretty even regarding black & white. If you’re black, you’re not a minority anymore. Used to be, but not anymore. Besides we all bleed red Which means we’re all human. Why bring racism into this debate? I do agree some prisons have a lot more black than white but it works the other way around also. Some prisons are predominantly white. They offered me 12 years for my 3 class c felonies! Which is ridiculous. Then they finally offered 6 years which I took because if I didn’t they said they were going to hang my ass. Idk where you are from, but in Tennessee the “criminals” are all treated the same & I got along with everyone in there, be it crip, blood, GD, Vice Lord, Aryon Nation or Brotherhood & all non affiliated peeps. I treated everyone like a person & was treated the same in return. We’re all God’s children my friend.

  146. Look my son as a young person got caught with a small amount of drugs and charged felony since 13 yrs later he’s raising a son solo , has a business and never been in trouble again . Yes he deserves his rights back.

Well since we as felons should have our gun rights yanked away why not take our right to worship god the way we want too I mean you know the constitution states it can not be changed so why is it we have somany of our rights violated daily by our government because unlike our forefathers Americans noe days are afraid to stand up in the face if tyranny aka our government Donald trump was right about 1 thing we need to make this country great again and how do we do that by standing up to our government leaders and saying enough is enough stop stealing our rights and let the people govern the land we didn’t put people in power to rule us but for us to decide what we want him to do we give them their power not the other way around so stop looking at this as 1 of your rights being taken but what it is if you violate one of a mans rights you violate them all because as it stands the government has bronken every constitutional right we have by changing or amending something that clearly states it can not be changed

  149. “SHALL NOT BE INFRINGED” I believe the average person can translate this. But you wouldn’t expect our congressmen have been fighting this translation for decades. Republicans seem to grasp it pretty well, Democrats on the other hand feel the 2nd Amendment has no place in the U.S. Constitution and are 100% against American citizens owning guns. Reality is the 2nd Amendment is there and Democrats have made it a top priority in their agenda to write and pass as many gun controls laws to where it will be almost impossible for any civilian to afford or own a gun…… “SHALL NOT BE INFRINGED” This started with the ending of slavery, because blacks would be free and that met they would become American citizens and have the right to bear arms. Even though free blacks before the war had these rights, white democrats of the south viewed slaves as property and not citizens so they feared these blacks owning guns. The proof of this is in the voting records of the 13th, 14th and 15th Amendments along with both Civil Rights Acts the last one being 1965…… “SHALL NOT BE INFRINGED” The first gun control law to pass was the ownership of machine guns. Race relations between whites and blacks were getting out of control and riots were popping up in major cities. Democrats did a study and found more black men were in prison for committing felonies, seeing this they wrote and passed the gun control law of felons could no longer own guns. Though they would never admit this, their past record shows otherwise. Today anybody can see over the last few decades crimes that use to be misdemeanors are felonies today, and almost all new crime laws are felonies. This pattern shows that gun control laws are 100 % political and prejudice to American citizens by our government and have nothing to do with a threat to society…… In 1986 the Federal Government allowed states to decide if they wanted to give felons the right to own guns, a few states have set guidelines that will allow felons their gun rights returned . Some states you can file for executive clemency through the governor and some states say felons will never own guns again. This again shows me gun control is 100% political and has nothing to do with a threat to society…….When a felon is released from prison he always has a time period of parole to adjust to society. Once he has completed all requirements set by the State Board Of Probation & Parole he is deemed no longer a threat to society, he has paid his debt to society and released as a free man just like every other American citizen. EXCEPT, his civil rights are violated by not allowing him to own a firearm to protect himself , family and his property as all other citizens have the right to do. Up until the 1990’s you could request your gun rights through the Federal Government but the government cut funds so you have better luck sending your request to Santa Claus. I myself sent in a Executive Clemency form to the Missouri Governor back in 2014, two governors later with three update request sent in a decision has not been made for a DWI felony almost 20yrs. ago…… “SHALL NOT BE INFRINGED”

    • Yes you can apply for set aside but expungement is better once in your life as a adult and have to pay a lawyer to put proper language in the expungement I had a felony and I have had my record expunged now I have a CCW if I can do it anyone can do it

  152. I got a felony in 2002 and got 23 years in a please bargain. I was caught with some pot in my truck. I was carrying it for some one who assured me I would not get in trouble, right. I got 8 years probation and reported every week. I kept a job the entire time. It seems like once you make a mistake and you do your time and obey the rules the problem is not only gun rights but being a felon. You can say you should have thought about that. Once you get a felony you must carry it the rest of your life. Politicians break laws everyday and come out smelling like a rose. I jutsr got laid off after 10 years and I am finding it very difficult to find a job with a felony at 58. It is like a scarlet letter. You are marked for life, looked down upon. If you have a felony how are you supposed to get a job. I know it is my bed and I have to sleep in it but paid taxes my entire life and I cannot even vote. The system needs to be looked at where money is not the driving force. Thanks for reading this

  153. i was hanging out with some people in 1993 and they had broke into a house before they picked me up and when we got stopped by the police i was charged with the same crimes as them guilty for being with them .I did not know I got a felony and ended up going to prison for it i did my time and i have never gotten in trouble again and it is crazy that i can have a gun to protect my home and my family…..

    • You can obtain a CCW permit again you have to file for a expungement from your home state you can only do it once in your life or set aside. But make sure you get a lawyer to put the proper language in your expungement or set aside cause you can only do it once in your life as a adult and in order to get it done the right way hire a lawyer I use to be a felon and I have my CCW permit it’s called a second chance law

It is possible to get your firearm rights back you have to fight the courts but it can be done if you got a expungement or set aside.People say you will never be able to get a gun license but that’s total BS you have to stay out of trouble for more than 10 years hire a good lawyer and do your own looking up about the laws for that state . You can only do it once in your life time as a adult but the trick is staying out of trouble more than 10 years is really hard for people to do then you have to make sure your expungement grants your right to own a handgun then after that obtain a CCW permit for personal reasons then apply call find out the required documents to apply

I think that if you dont forgive and let the people have there rights back your just creating thugs if they dont have rights and can’t get good jobs why shouldn’t they act like thugs that why your sentenced so that you pay back to society what you have done wrong instead its really a life sentence. I agree give them there rights back after a 10 year wait with no trouble. Some people do get rehabilitated

  156. I was convicted of a felony, but it is what is termed a wobbler. Did not serve prison and had the court enter at the end of probation “reduced to a misdemeanor 17 PC. So I am suppose to have my gun rights but the FBI refuses to allow purchases. To those who object to felons and mentally ill but under treatment owning a weapon after paying there debt or being treated, you seem a bit unreasonable. There is suppose to be a process to restore rights for mentally ill people but it is not funded so it goes nowhere.

    If you and I have legal rights, why are these supposed rights non-existent when you need them. The system can correct, but it is costly. Why should it require an attorney to restore your rights.

Everyone has their opinion on this issue, but what most people fail to realize or acknowledge is that all laws restricting the ownership of firearms violate the constitution of the United States. The Second Amendment clearly states that “.. the right of the people to keep and bear arms SHALL NOT BE INFRINGED.” All laws prohibiting Americans from possessing firearms are unconstitutional. The state and federal judiciaries have caved in to emotional blackmail and erroneously created case precedent that allows them to violate peoples’ constitutional rights for the false flag of ‘public safety’, and the majority of American citizens just roll over and take it.   159. I have a delivery manufacturing felony for sharing a joint which is wrong on every level. No reason I should have lost my rights so I have to disagree with you. Someone that got a felony that involves violence with firearm on the other hand I would agree. If the felony wasn’t due to violence should never lose their rights, it makes no sense at all.

  160. I understand people don’t get the perspective of a felon. They don’t know what it’s like to deal with the legal system since they were seven years old. Parents going through major divorce beating the shit out each other. Taking it out on us kids. Growing up getting the shit beat out of you.them putting you out side all day chained to cinder block to carry. Choking you, and hitting you with metal hangers, hot wheels tracks, brown extension cords so on and so forth etc. Then you turn out a bad person go to jail get sent through every state funded program after program teaching your how to be successful and a better person the take a plea to go to prison and take a felony just to get off the loop hope of probation. To be sitting here today with a 18 month old son. Which I would never have could have imagined I would ever be the father of. With another on the way now. A paid for house a career and love for life in general with no rights or way to protect it God for bid someone came in my home armed.

  162. I was convicted of grand larceny in 1984, I completed the 5 years probation and 6 month jail time I received as a result of my crime, I have not had anymore convictions since that time and want to get my gun license for hunting, what can I do?

    veteran, marry to the same woman for over 30 yrs. we go to church every Sunday , we are bless with a beautiful daughter, great son in law , handsome grandson
    nice little house in Stroudsburg Pa. worked construction most of my life, thought we were pretty happy,
    UNTIL i came home one night and this man decided i was an easy target he putted out a knife and try to rob me,
    well. we wrestled for a while for possession of the knife–he lost but since i stabbed him with knife i got arrested and charged!..i did 2-4 yrs for protecting myself.. lost my job, my rights, my dignity, put my family through hell and in a financial distress. “FOR WHAT?’…
    ” NO BAD THINGS HAPPENS TO GOOD PEOPLE!”….you would be a FOOL TO BELIEVE OTHER WISE!
