I just entered an order in a MAR setting aside a judgment activating a suspended sentence upon defendant’s motion (ostensibly based on 15A-1341(c) which does not exist but is still on the AOC judgment form) with no violation report pending.

Suppose a defendant is convicted of a crime and the judge wants to (or, in a “C” or “C/I” cell in the sentencing grid, has to) suspend the sentence. Can the defendant refuse probation and elect to serve the sentence? Unless the defendant’s crime was committed prior to January 1, 1997, the answer is no.

Is the above still the case ?
Some Judges in Alamance Co. allow a probationer to Electing to Serve a Sentence and some Do not.
Also,Electing to Serve a Sentence in on the AOC form
