I was just sentenced to 7 days in jail last month and when I reported to the jail to serve my sentence they (the jail) could not find the court order. That being said the jailer did give me a notarized paper stating that I was in compliance and sent me home. I asked my probation officer if I was home free and he said he will re-do the paperwork and get me to jail anyway. Is this not Double jeopardy??Is this legal for the probation officer to do this??? I was convicted of DWI in North Carolina. Any Advice would be great.
