The revocation period is one year. G.S. 20-19(c1). The person is not eligible for a limited driving privilege because the punishment is not Level Three, Four or Five.

T.J. Right you are. I omitted discussion of the privilege restriction for high risk drivers so as to avoid an unduly lengthy post. (I’ll note, though, that you executed a pretty good summary in one sentence.) I may explore these issues in a future post. Thanks for noting them here.

And don’t forget the LDP with a BAC of .15 or higher, which requires non-operation for 45 days after conviction, even more restrictions on driving, and the installation of an ignition interlock device for the first year the defendant can legally drive (with or without the LDP).

What of a Level 2 where the only grossly aggravating factor is 1 previous DWI conviction which occurred 4 or more years prior to the offense date for the current charge the driver is facing?
